Refusal due to Social Assistance not paid ?????????? Please help need guidance

Hi friends

I am Canadian citizen
I submitted through representative.
I submitted my application for spousal sponsership to New Delhi, India

File submitted - august 2015

In December 2015 cic transferred my file to New Delhi and send me letter that I am not eligible to sponser my wife due to reason -----------That I have not paid Social Assistance my X spouse used.

Then in Jan 2016 I paid Social Assistance as per Canadian government .
And sent all receipt to Missaauga and New Delhi Embassy.

In August 2016 my representative recieved letter from
Embassy that file has been rejected due to Social Assistance not paid.

I can appeal but I don't know why they refuse,
I already send them all receipt of Social Assistance paid.????????

what to friends please help me out??????

Go talk to your local MP and inform them of the situation. They may be able to help.

Send the copies of the receipts to CIC again and inform them that the debt was paid long before their final decision.

Try to have them re open the file.

If you are unsuccessful in that I would advise to just apply again rather than appeal.

An appeal will take longer than simply reapplying.

i`d recommend actually calling the welfare agency you paid to make sure you are taken off their list. we have seen cases where a person has paid the debt/stop taking welfare, but is still listed as receiving welfare or still owing a debt. you will want to get a letter from the agency that confirms the date you paid the debt and they no longer have you listed as owing.

I actually know a girl who was refused because CIC mixed up her name by her brother's name who was getting social assistance. The siblings have only one letter difference in their names. She went to the welfare office and got a letter and sent her application back. The welfare office gave her a hard time at first but they eventually gave her the letter. She was able to sponsor her husband who is in Canada for almost a year now. (they were applying from India Visa Office too) So as CDNPR2014 recommended, contact them, you might be able to resolve it from their end.

The app was refused because the sponsor was found ineligible at the time of processing.

There is a question in the application, on IMM1344:

1. If you are found ineligible to sponsor, indicate whether you want:

a) to withdraw your sponsorship
b) to proceed with the application for permanent residence

It is always advised to select option a because if the sponsor is refused, the applicant will always be refused, unless there are some very significant H&C grounds.

As the app was transferred to ND after you were refused as a sponsor, it seems you selected option b. Had you selected option a, the app would have been returned when you were refused so you could sort out the debt and re-submit.

Because now I have 30 days left and I don't have any option left

And for government welfare also I have to go back canada in urgent.

My representative was telling that we will appeal and he hope file will transfer to ADR
AND it will make it early.

If your representative had chosen option a, the app would not have been sent to ND. It would have been returned to you after sponsor refusal. He chose option b.

Your representative sounds like an idiot who is after your money. There is no point in appealing. Just re-apply on your own.

You can try but since you were correctly refused, IRCC may refuse to re-open the app.

When I paid Social Assistance
I got receipt from Government stating
Confirmation of Repayment of Social Assistance
It's Says that I have paid all dept for period they asked.


And if u have any idea
How long appeal will take if I go through that decision.

Talk to your MP in Canada and see if he or she can help. You should also ask the program manager in New Delhi to reopen the file. You can send a letter of explanation and proof that you had repaid the money before they made the decision.

The length of time it takes for an appeal depends on where the appeal will be held, and whether it will get an ADR hearing. For example, some people wait two years for an appeal in Toronto; in other cities it might be only one year. If you get an ADR hearing, it will be less than a year probably.

Reapplying usually is faster than appealing.

And I have kept file through representative, so will program manager in new delhi will talk to me regarding this ????????
