Dear all,

I found myself with job experience under the filed of cosmetics processing according to NOC 9212 & have 69 points with the assumption of overall 6 band in IELTS.

Now I want to ask,

1. If any how the immigration office considers me not eligible as per 38 occupation list then would they refund my application fee?

2. I haven't been giving the IELTS yet, so with my presumption, can I fill the columns in the application forms regarding English proficiency.

3. My wife & few days old cute son have not going to accompanying me to Canada, so I still need to fill their passport details in the application forms as they don't have their passports ready at this time or I can give the details of the same to immigration after pre assessment of my application as filling the columns of these with not applicable?

I will be very thankful in this regard.

first of all CONGRATS for the new baby..

1 yes they will refund your fee
2 you hav to give the test in order to get the exact score.
3 even if your family joins you later then you have to make passports as well as mention their name also make birth certificate of your child and family certificate. passport only takes 15 working days so y dont you apply early so that you can get them on time but first you have to get the birth certificate of your son. hurry for this cuz eid n cristmas hollidays r cumin...!

Yes u are quit right about from where should I start, that is, applying first for birth certificate as soon as possible then passports of both of my wife & son. After having all these, I submit the application then. And IELTS test is not necessary before applying. Am I right to all said?

Also Sonea, I'm worry about one more thing for which, I haven't search for is this of mine decision that my wife & son are not going to accompany me to Canada even we have close relatives living there who can provide shelter to my family without any charge for initial few months?

I mean to ask will my wife & son joins me Canada when I think the right time is come and the process of their immigration will not as creepy as of mine?

c i think you shud take them along you its realy ez for you if you hav relatives there ... bcuz if you dont apply for them with you you'll have to sponser them later so it whould take you longer. and i think you cant leave your little son for even a day.
yes you'll have to make the birth certificate first then family certificate (Bay form. as its called in pakistan) and after that you can apply for the lill one's passport.
get all the documents nikah nama, bay form, and all documents translated into english
for your relatives get all their information visa copy or PR,passport copy get their proof of relationship with you like if some1 is your mother's brother get your mother's family certificate or any educational document of both (your mother and her brother) mentioning their father's name etc.
and for ielts when submitting these documents i think you'll also have to submit the result
so get everything compiled at your end

Salman, congratulations on having a baby.

My thoughts on your questions are slightly different.

1. If your application gets to an immigration officer that means it got to the consideration stage. And once an application gets to a consideration you get a final decision (for or against) and then the fees are not refunded.

2. I was also thinking about IELTS and I have been told that although there are ways to get around it by providing various proofs to confirm your proficiency in English but those who have been there and done that recommend that you have an IELTS result before hand to avoid frustrations and make your case solid.

3. Well, I don’t have a family yet so I can only tell you what I have recently seen someone doing with regards to putting wife/children on application. A friend of mine who is going to apply soon and although he’d like to bring his family to Canada at some point in the future but doesn’t actually want to take them with him. He wants to go it alone at first but his lawyer has told him that he still has to put the names of his family members on his application. However, he wouldn’t have to pay the application fee for them. (And correct me if I am wrong, there IS something on the new forms which says you have to include each of your family member’s names on the form whether they do or do not want to accompany you).

Yeah first thanks a lot for congratulations and also for such a detailed reply.

Well I wanna share with you some which I got from CIC web site in reference to my questions asked in this topic.

1. If your declared occupation does not correspond to the list of eligible occupations identified by the Minister of Citizenship and Immigration, or you do not have the required experience, you will be sent a letter that:

   * provides details on the reasons why your application is not eligible for processing
   * confirms that a refund for the processing fee will be issued by CPC‑Sydney within a few weeks

2. Applicants who are using FSW with occupation in list should not submit their test results or written submission to CPC-Sydney. The test results or written submission will be requested at a later stage if the application is recommended for further processing by a Canadian Visa Office.

The source is CIC web site and couldn't be wrong, I think.
Acutally, I want to ignore giving IELTS test before applying as to see whether they recognise my professional experience or not. As far as accompanying my family to Canada is concern, I think this can be decided after approval of file to further processing at embassy.

i think cic will give you atleast 45 days for submition of your ielts results. they take ielts test 2 times in a month here in pakistan. so dont worry you'll hav enough time.

I know CAD$550 is a lot of money for some people so theres no harm in doing thorough research and taking different opinions before you decide to put your aplication in.

I'm not saying what Sonea begum said was wrong but why would someone apply in the first place if their occupation was not on the 38 . I know CAD$550 is a lot of money for some people so theres no harm in doing thorough research and taking different opinions before you decide to put your aplication in.
