Refund of PR Application Processing charge from CIC

Hi,

I would like to request your kind attention and consideration for my below inquiry.

I have been submitted my application to the Immigration Department for the PR under Federal Skilled Worker/FSW program. Our application has reached at CIC Sydney on 12th March 2012.

We have taken the assistance of a Consulting Group in Canada to represent us to the CIC.

Later on we have received the intimation/email from our representative stating that the application has returned from the Immigration Department due to the Cap reached to the particular occupation.

Also we were charged $1,250 to process our application and still now no refund has been issued for the above said amount. Hence we request you to please let me know our application has been returned from CIC due the Cap reached or any other reason.

If it is due the Cap reached, can we able to get amount $1,250 as refund. Also if there is any other reason for the rejection.

1. If your agent submitted the application with fees of $1250, then the refund was sent to the agent a long time ago, They also probably got the refusal a long time ago as well. I suggest you contact the agency.

They replied that we were charged $1250 to process the application and the file number has issued by CIC and confirming that no refund has been given by CIC.

Hence we request you to please let me know our application has been returned from CIC due the Cap reached or any other reason. Also they have mentioned that CIC has issued the file number. Please let me know CIC will issue any file number for such rejection due to Cap.

It appears that you have to get your refund via the agency.

If the application was returned because the cap was reached, then the fees were refunded.

Normally if the cap was full, u won't be charged so your agent was not charged n u should get a refund from them. However how much was d total amount u paid cos n what's ur family composition cos ur agaent will also charge u their own processing fee + cic application fee.
Ask ur agent to mail u a copy °ƒ letter sent to them explaining about the capped Noc n plan to send d application back.all other reasons will be in this mail

Please let me know the CIC will issue any file number to the PR application which is returning from CIC due to CAP..

I had my application returned in the past for the same reason - it was received after the cap was met. I included the fee payment form for the required amount and it was not charged on my cc. All the documents were returned with an explanation letter.
You will not have a file number as the application did not go to the processing stage. In btw, how did you make the payment? was it a money order/cheque or fee payment form to charge your credit card.
I cannot see how the agent can keep the fee if you used the above mode of payment(s) unless you wired the money to the agent to include the money order/cheque with the application.
