Hello,

I am asking this question for a friend whose refugee claim is denied and her wife & children claim is accepted as their country of origin are different. Some people are recommending him that he can stay in Canada and once his spouse gets the PR then he can also apply for it. Please share if anyone had such experience of staying in Canada without any status?

Thank you!

He can try to remain in Canada but due to the denial his removal order has been triggered and has no current status in Canada. If he is contacted by CBSA he can plead his case. CBSA often lets people check-in with them instead of being deported. Really depends on the situation and the time until he regains status.
