Reconsideration or a TRV application?

Hello,

A friend who is studying in Canada applied for spousal open work permit and study permits for the kids but the application got refused. The officer had concerns with not showing proof of income taxes (they are self-employed) in home country and also source of a large deposit in the student's bank account (<$10K deposit).

A reconsideration was submitted but they never heard back. Now my friend is sick and will be undergoing surgery. The dilemma is should they try again for a reconsideration for the work permit and study permits adding the need for family care OR apply for a visitor's visa citing the need for family care and support while recovering? Secondly, should they apply for all family members or just the spouse only? The kids are minors and really can't be left alone in home country.

What is friend’s program and length? What were reasons for refusal? How many kids? They need to show POF for study permit for the number of people in the family so over $30k plus tuition. If undergoing surgery then is friend no longer a student?

MBA to be completed Dec 2025.
The officer had concerns with not showing proof of income taxes (they are self-employed) in home country and also source of a large deposit in the student's bank account (<$10K deposit). They had about $60K combined for PoF.
2 kids.
He will still continue with school but might be off for a couple of weeks to recover.

So where did all the money come from? IRCC needs it documented why a large sum of money is dumped in an account, and where it comes from. So proof of funds is around $35k plus tuition. Seems like rightly refused. If sent in reconsideration there are no timelines. No sense in applying for TRVs now because of processing timelines and IRCC expects that family will stay and want to work and go to school.

Where are they applying from? May want to reapply for SOWP/study permits with valid explanation of where all the funds came from if dumped into the account. Assume this is all cash in the bank and in personal not business accounts. Business accounts are not considered.

The funds were not just dumped in the account. They provided history for up to 1 year of funds in personal accounts - most of which were in investment accounts and a business account as well. Those accounts did not have alarming large deposits.

The student had $7K sent into his Canadian account which was a refund for a debt from home country but it came through a 3rd party. IRCC also wanted to see proof of filed taxes as we do have here in Canada but they haven't filed their taxes in a while.

They wanted to send in another reconsideration highlighting the health concerns but not sure if that will do much. Hence, wondering if TRV might be a better option to explore as they will only be here for a short time to provide care and emotional support for the student in Canada.

So business accounts are not considered, only personal accounts. Do they have the cash in personal accounts? So they have a debt in home country and have not filed taxes…that will raise red flags.

Reconsideration is for an error in law to respond to reasons for refusal (funds). It is not to bring up health concerns.

Where are they applying from because processing can be long? TRV is not really an option if plan is to stay and work and have kids go to school.
