I will be getting married abroad in June to a South African citizen and I am a Canadian citizen. My question is - If I draw up a marriage contract in South Africa, will Canadian courts recognize it if anything would happen with our marriage? I am planning to draw up an contract which will be Out of Community Property with the Accrual System, which means - During the marriage each spouse retains control of his or her own property, builds up his or her own estate and each is responsible for his or her own debts.
On dissolution of the marriage by death or divorce, the value of the assets obtained during the marriage (the accrual) will be shared equally.
