Recently laid off and updated employment evidence requested...

Hello everyone,

So far the sponsorship of my wife has been fairly smooth, we were told that an interview was waived, and we recently got her updated background check and were about to send it out. Except we received an email asking for both the background check and employment evidence to be sent in at the same time. Problem is that I was laid off at my work place yesterday (fantastic timing eh?) and I'm currently seeking employment.

I'm really unsure what we're able to do in this situation and we fear that we might get denied or have snags in the whole process. Or even worse... have to attend an interview because of this shuffle.

Any info is really helpful and much appreciated.

And you're sure it's YOUR employment information and not your wife's they need?

If yes, then I suggest you answer them as the situation is now: you were laid off yesterday, and are in the process of marshaling your resources to commence job-hunting. To forestall any section A39 concerns (financial inadmissibility) emphasise your wife's employability (language skills, work history, professional qualifications, etc) and point to any savings/investments you can dip into for short-medium term expenses.

I thought spousal sponsorship required no financial admissibility? Which is why I'm extremely confused to why I must prove my employment.

Section A39 is concerned with the applicant spouse's ability to become self-sufficient, and that the arrangements in place for their care and maintenance do not include reliance on social assistance/welfare. So, while there is no income requirement for sponsoring spouses, you do need to show that the person can become self-supporting and that there are arrangements in place to care for their basic needs (food, clothing, shelter), otherwise the applicant MAY be deemed inadmissible for financial reasons.

So, what spousal sponsorship does not require is a minimum necessary income. You still have to show financial admissibility. You can't be denied the right to sponsor because of a lack of income, but your wife can be denied if they don't think the two of you can support yourselves without needing welfare.
