Greetings,

Seniors - please help

I am employeed by Canadian company that has assigned me on rotation in one of their african location since 2014 which is clearly stated in my employment contract, I received salary from Canada office, also have T4 and filed Tax Returns from 2010 till this year.

I included all documentation along with the application but by mistake I signed and dated it June 2016 rather than Mar so they sent me back only the application to correct which i did and send it to their office in Sydney. Last week i received letter from CIC Hamilton ontario office saying they will be investigating PR determination and send me questionaire which is asking same type of questions that were in PR card application and again requesting me to send the proof of canadian employment, Passport stamped page copies etc which I have already given them along with T4, Tax returns, Company letter, employment agreement, Mortgage Documents etc.

They also asked if I am in Canada or out of Canada - does it make difference i sent this application package from oversea's highlighting i am out of country - also asked what date i will be back in Canada which is july 19th

They want me to fill up this questionaire and send it to them by 20th July. I will be in Canada by 19th July as will be entering via buffalo as my PR card expired this month.

Question..

* Any reason they are requesting info again which is already provided to them?
* Shall i fill application here in over seas and send it by courier or I should deposit application package by myself so that i will be checking box i m in canada rather than being out of canada.
* on the envelope can i put Attn to officer name that send me this questionaire as no return envelope was provided.
* what will happen if in case i got late to submit this paper work by couple of days or so? (worst case scenario) as i will be coming to canada on july 19 and they want all supporting material by 20th July 2016.
* Shall i include following covering letter that might help on H&C grounds?
* Shall i try to meet the officer when i will be droping my application package personnaly at their requested address?
* do you think i should withdraw PR renewal application and reapply when i got 730 days in canada physically? Can i withdraw my application at this stage when they want to initiate investigation.

One of the most important conditions when applying for PR Card renewal- you have to be in Canada at time of application so that's one reason why you have been asked for all the documents.

I applied for renewal of PR Card while I was in Canada - and provided all documents included TR, T4, Canadian Business Employment Confirming assignment overseas etc.

The other problem you have is that it is not enough to be employed full time by a canadian company. The job also needs to be an assigned position and by that CRA means that the position should be a temporary one, with the intention of the company being to provide you with a position in Canada at the end of the assignment.

In your case, first it's been 2 years there which will raise some flags (doesn't mean it's not allowed, just scrutinized) and second from your description it doesn't seem that this company has any plans for you back in Canada, it didn't offer you any job here and didn't seem to be interested in having you ever working for them here in Canada.

If it is not the case, then you need to document this, the company needs to state that it has plans for you to work in Canada after your assignment.
