RECEIVED LMO FOR ALBERTA . WHAT IS THE NEXT STEP ? PLEASE HELP

Folks,

I am from Chennai (India) & I received my TFW-LMO from employer last week but i have few questions on that.

1. How do i know my LMO is positive ?
2. What is HRDSC approval & how long it will take ?
3. How long it will take to get my visa stamped ?

What exactly did your employer send you? The whole LMO letter and annexes or just part of it?

2. What is HRDSC approval & how long it will take?
The LMO is itself the HRSDC approval. More officially, HRSDC is now called ESDC and an LMO is called an LMIA.

3. How long it will take to get my visa stamped?
You can check work permit processing times at http://www.cic.gc.ca/english/information/times/temp/workers.asp

If your application is approved, all you will get from the Canadian embassy is a letter of introduction. When you arrive at the port of entry in Canada (airport most likely for you), the border officer will review your qualifications and decide whether to issue the work permit.

I think it is whole LMO because it contains all the details like wages, food, accommodation, my DOB, expected date of joining, my full name & complete employers details etc.. (any thoughts on this ? )

Question to you. In my LMO, There is option called '' Is the job temporary with intent to permanent? '' my employer marked as 'YES'. what exactly it mean ?

Is the job temporary with intent to permanent "Please indicate “yes” if you intend to develop and retain the foreign worker in the position and eventually make this person a permanent job offer. Please indicate “no” if you intend to fill a labour shortage temporarily by offering this job to the foreign worker until you can hire or train a Canadian or permanent resident".

I'm sorry but why would you doubt the authenticity of your LMO? Do you doubt the employer is genuine in offering you a job? I don't get it and I can't imagine why someone would go through that trouble considering that if it were fake, this would be uncovered at the port of entry and all that.

I did some research about the employer & their offering in their company. I guess it is not a fake LMO. But, just thought of making sure it is 100% genuine LMO 8).

Alright i have my LMO now. What is the next step ? Please advise.

If you've had direct contact with the employer and were not asked to provide any payment to get the job, then it's more likely to be a genuine job and genuine LMO. That said, there are unethical people everywhere so just be cautious and sensible about whatever your future interactions entail.

Now that you have the positive LMO, the next step is to apply for a work permit. Start here: http://www.cic.gc.ca/english/information/applications/work.asp

You should take the time to become familiar with the above website - it's the official site of Citizenship and Immigration Canada.

The next step is to apply for your work permit. Visit the cic website for your country for information on how to go about this and what documents you'll need.

Hi,

Thanks again for clarifying on fake LMO. (Per my agent he says i can contact my employer directly if required).

Question to you ? Just spoke with my agent & he says he has sent my LMO for HRSDC approval & told me to wait for one month for getting the approval .Can someone clarify on this please?.

If name was needed to be added to LMO, OP won't have said earlier that it contained his name and other details. Plus the involvement of agent makes me think there is some more detail to it.

To the OP, the first and most important thing, have you been asked to pay ANY THING in order to get the job or get to Canada? If so, and what you said above about "sent to ESDC for approval" makes me think there is some thing else to the story.

YES I PAID SOME PARTIAL AMOUNT

NOTE: they also given me the cheque for the amount i paid. Even yesterday also i verified the cheque is still valid.

The agent got my Passport as well and told they will get HRDSC approval & told me to wait for 1 month. Please tell me what all should i ask them to make sure they are doing the right process and not cheating me!!. Please advise asap.

Only make the full payment (if you have any pending) when you have actual approval i.e. visa stamped on your passport and letter of introduction received.

I believe you do know that based upon laws in Canada, it is illegal to charge any employee for any money regarding getting him a job and LMO etc.

It is the sole responsibility of employer to pay for that.

For a regular LMO (now called LMIA) once it contains all your personal details such as name, dob, passport number, salary, position and other terms, there is no further approval kind of thing. All approvals are done before getting you that document.

If agent had said they had an "unnamed LMO" (which could be used for any employee - not just you) and would need to add your name to it, then that is normal procedure. The above is not. Hence i am inclined to believe there is something wrong.

But any way as long as you haven't paid huge amounts to discover being cheated latter, you shouldn't have much to worry.

What do you mean - you paid some amount and they then refunded you? This doesn't make sense to me.

ESDC doesn't ask for your passport - the employer just has to fill your name, DOB, citizenship, place of residence, and status in Canada on the application. So yes, it seems there's something weird going on here.
