Hello, I was wondering if you anyone can help me with this rat race the CIC has put in front of me.

I am a Born Canadian Citizen and I have asked to women of my dreams to marry me. She is from Romania and Has been living in England for 4 years now. We have not gotten married yet but are looking to see what would be the best steps so that she may come to live with me in Canada. As for the first step:

Step 1: Do I get married first? If so, is it easier to get married in Romania, or in Canada. (she has been give a visa before to come to Canada)

Step 1b: Is it possible to sponsor her as a Fiance so that she may come to live in Canada and then marry her when she get here.

Step 2: After Marriage assuming that we got married and she is not living in Canada yet. What forms do I apply to so that I may sponsor her in Canada.

I know this seems confusing at first site but I believe it is because I am just very confused. Any help would be great. I cannot wait to hear from any of you.

Hey,

You can not sponsor your spouse before you either get married, or live together for 12 months. I assume that you have not lived together for 12 months, so if you want to go ahead with the sponsorship, then you need to start getting organised!

You can marry in Canada or in Romania, it doesn't matter. as long as the marriage is valid and recognized in the country where it was performed, CIC will accept it. So it's your choice.

there is no "fiancee visa". what she could do, is apply to come to Canada as a tourist. THen once she is here, she can get married, and you can sponsor her. If you sponsor her "inland" she can not leave the country for the duration of the application (currently 14 to 16 months), but if you send the application BEFORE her tourist visa expires, she will be allowed to stay. She will get a work permit after stage 1 ( 6 to 8 months), but she can not work before that.

She could also come to Canada as a tourist, get married, then you sponsor her "outland", but she can stay in Canada. You would need to extend her tourist visa, but with the proofs that she is applying for family sponsorship, there are good chances that the extension will be approved. Her application would go first to Mississauga ( 1 month or less ), then to Bucharest ( stated as 12 months). http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp#europe
12 months is the time it takes to finish 80% of the applications, so if you have a straightforward case ( no previous sponsorship or marriage, no children involved, enough proofs of relationship etc.), then there is a good chance you will be approved in less than that, but you can never count on it.

Of course - inland is only a possibility if she gets a visa to come to Canada in the first place. If not, then outland is the way to go ( and in that case, you also will only be able to get married in Romania, but it doesn't matter for CIC).
Read the first post by Leon (spousal sponsorship), only the first page, it will give you an overview, and on CIC website you will find all the forms - but you need to decide first whether inland or outland are best for you, so I recommend you read on the forum a little before going ahead.

If you have lived together for 12 continuous months there is the common-law route, but no fiance application. If you can travel to the UK, you can get married there also. It doesn't have to be her country or yours you can get married anywhere.

The entire process is confusing. Read the guides well, after a few times you will get the hang of them.

Also - because she has been living in the UK for 4 years, she can ask that her file be processed in London rather than Bucharest, it's a slightly faster office usually, so that might be an option.
