Hello everyone,

Here is my situation.

My post graduate work permit will expire on May 21, 2012.
My PR application under the CEC category was rejected.
I am applying again under common law on May 1st, 2012.
My employer can submit an LMO and apply for a regular work permit as PGWP can't be renewed. (However, I don't want to be stuck with one employer).
I have a job for now, but I am an interpreter and I like to continue to work as a freelance interpreter.

Here is my question.

1. If I submit my application for PR under common law, will I have implied status so I can continue to work (based on my PGWP)? Or should I also submit my application for an LMO and then work permit as well? (then it is closed work permit, isn't it? so I can't work as a freelance interpreter).

2. My SIN and health card will be expired (expire on May 21) but there is nothing I can do about it, right?

I don't believe you can contine to work if you don't have an LMO.

Under family class sponsorship, the applicant is only allowed to work if...

1) for an 'Inside Canada' application, stage 1 approval is granted, which talks about 11 months' time, or;
2) for an 'outside Canada' application, permant residency is granted, ie, when the overall process is completed, timeline depends on the Visa Office.

Because you are on a PGWP, you will only be able to continue to work if your employer obtains an approved LMO and you then apply for a close work permit. Because the PGWP cannot be extended, you can't get implied status.
