Hello,

I am staying in Toronto,Canada with my wife from Last couple of years on valid Work Permit and TRV(Worker). My WP and TRV will be expiring on 31st Jan 2011 and My wife also has open work permit and TRV(Visitor) until 31st Jan 2011.
We have applied for extension of Work Permit on 20th Sept 2010 and awaiting for the response from CPC.

I am planning for vacation going back to my Native Country(India) during this Christmas (2010) from 13th Dec 2010 to 7th Jan 2011. I would like to clarify few things before I request for leave to my office.

Q1.As per CPC processing time for now, they are taking 76 to 80 business days for WP extension approval which means I might receive response from them by Mid of Jan 2011.
Is that fine if I travel outside the canada if my WP application in progress.

Q2.Does my TRV(Worker) and Wifes TRV(Visitor) allow me to come back to Canada when TRV has expiry date of less than one month or do I need to change the vacation plan to come back in Canada before 31st Dec 2010 (before one month of date of expiry of TRV).
We wanted to come back to Canada on 7th Jan 2011 but not sure if we will be allowed to get in if our TRV has expiry of 31st Jan 2011.

Appriciate your quick and detailed response!

Thanks,
Nil Krishna

Thanks,

1. Yes.
2. To return to Canada, you require a multiple entry TRV, if you have one then you can re-enter, if not you will require a new TRV.

Thanks PPM for quick response.
I have additional query on your response for Question number 2..
Yes I have Multiple entry Visa (W-1 Worker) and my wife has Multiple entry Visa (V-1 Visitor). However, while searching about this question earlier, we found one note in FAQ @ CIC.gc.ca " A multiple-entry visa is valid for a maximum of five years or one month prior to the expiry date on the passport/re-entry visa, whichever is earlier" .
Here its mentioned that its valid one month prior to expiry date of re-entry visa. I am worried on this part as am planning to come back on 7th Jan 2011 and my visa (W-1 and V-1) are expiring on 31st Jan 2011.

Please help. Thanks , Nil Krishna.

i just called CIC at 1-888-242-2100 (press -5-0) and talked to the Rep.
She confirmed that re-entry visa valid one day prior the expiry date
The one month rule applied only to new applicant (first time entring canada)

if you are still not sure, please call them to double check. the service is good, you dont even need to wait..
