R183(6) Re-Entry on Open Work Permit

Hello,

I am sponsoring my fiancee to immigrate to Canada and we are in the process of getting approved. She entered Canada in the beginning of 2015 under visitor, got her IEC work and travel activated in November, and applied for an open work permit extension in Jun 2016. She was able to extend her IEC Work and Travel visa into an Open Work Permit that is valid until October 2018. The condition to leave Canada is set for October 2018 as well. The bottom of the document states "TEMPORARY RESIDENT STATUS MAINTAINED AS PER r183(6); FC APR PENDING" and the very bottom states "DOES NOT AUTHORIZE RE-ENTRY TO CANADA."

In March we are travelling to Ecuador through Mexico for two weeks. If we bring her work permit, sponsorship papers, etc with us, will we have problems getting her back into the country? I am confused as I have read conflicting reports stating that the extension to the open work permit may be rendered null and void if she leaves Canada. Is this true? Will the open work permit take precedence over the fact that she's been extending her visitor visa, IEC work and travel, and temporary residence for the past two years?

I greatly appreciate any insight to our situation. Thanks and happy new year!

Hi

The OWP will remain valid. The permit states it doesn't authorize re-entry because entry is never guaranteed for foreign nationals. It is always up to the CBSA officer upon entry.

Assuming she is visa-exempt, she will also need an eTA.

I will state that it is not recommended to leave Canada during an inland application because there is always the possibility, however tiny, of being refused re-entry.

Thank you for the confirmation. We will take the chance as we always have all the correct documentation etc and last time we left and entered (trip to Cuba, then activated her IEC work permit) there were absolutely no issues whatsoever. I don't foresee a CBSA agent having any issues other than the concerns I described above.
