Hello Guys,
I have a few questions regarding family sponsorship, can some one here please help me replying...
I am currently a Canadian PR since Nov 2011, I am planning to get married in Nov 2012 in India, my spouse is currently on a work visa in usa and we are getting married in India and she be returning back to USA until she gets her Canadian PR.

How do I start my Process is it from Canada or India or USA?
Will the PR 2nd stage application go to India or USA , I am worried as she is currently in USA and citizen of India and processing time is more in states compared to India.
Are there any tips before getting married that can speed up my process as I will be visiting India for marriage only 2 to 3 weeks.
Will I be applying my application package from India or from Canada after marriage?

Appreciate all you response...thx in advance.

Hey Roam,

Welcome to the forum and congratulations on your future wedding!

You can start preparing your documents now. Start gathering the proofs of your relationship, print, read and fill out the forms, together with your futureu wife ( her from her side and yours from Canada) etc. Once you get married, get the marriage certificate, put together your application and send it to CIC (Mississauga as you will be applying outland).
If your wife has been legally admitted to the US for more than a year, she can choose US as a second stage VO, but as she is Indian she can also choose India, no problem. Just put New Delhi as your VO on the form, and they will send it there after the sponsorship approval in Canada.

Any tips? take lots of pictures with your wife, with family and friends, keep your boarding passes of your visit, and any proofs that you are a real couple, and that you are not just getting married for your wife to gain status in Canada ( I'm not saying you are - I'm just saying that you will need to prove to the VO that you are a real couple). Print the guideline and see what type of proofs they need.

For your wife, she should start asking for her FBI record, as it takes more or less 2 months to get it - but it's only valid for 3 months afterwards, so plan it so that you receive it just before sending off your application.

You can send your package from wherever you want, as long as it is completed, and you have all the proofs, then you can send it.
Good luck with your application, and don't hesitate to ask questions if needed.
Best,
Sweden

Hello Swedon...thank you for the reply.
I have another question, when I go to India for marriage, should I apply from India or should I apply when I come back to Canada?
Can the medicals be done in advance in India so that I can submit with the application?
As its been less than one month my spouse came to USA, can she apply for Police Clearance and criminal check in India ?
are there any other options to be in Canada other than waiting for 8 to 9 months while the application is in process?

Please advise....thx

Be advised that New Delhi requests the applicant's passport as part of their normal processing procedures, NOT when they are ready to issue the visa. As Indian passports may not be mailed internationally (it is illegal), your spouse will have to take it to India herself. She would then be unable to travel out of the country until her visa is ready.

As a PR, you must be resident in Canada when the application is submitted until your spouse lands in Canada. Short visits outside Canada are permitted, living outside of Canada is not. If you are found not resident, you will be disqualified as a sponsor and her application refused.

Your spouse will need her police records for India and any other country she has resided in for 6 months or more. She can do the medical in India.

For the medicals - it can be done in advance, but be aware that if you do it too early you might have to redo them as they are only valid for one year. Also - once given the PR, you have to land within a year of the date of the medicals, so if you do them too much in advance, you will have to do them again.

There is no other option than waiting for the PR to be issued... you can try to apply for a TRV for your wife to come and visit you but they are usually denied if you are married, unless your wife can prove very strong ties to her country.

Good luck,
Sweden
