Questions about Valid Implied Status

Hello dear applicants,

I have a question regarding the condition of 'Implied Status'.

I have sent a BOWP application without an AOR by mail to gain one to two months of work experience. I understand this application will be rejected as incomplete. And, my TR will be considered in status until the TR document expires which is tomorrow 06.19.2016.

Here is my question:

- Can I continue my current job until the 'rejected' decision is made; Or, I should stop my current work immediately even though the decision of this application has not been made yet.

- if I can continue to work until the day the decision is made. Is this period of my work experience, which is work experience I gain after 06.19.2016, still valid?

Hi,

1/ You will be considered under implied status till you receive your rejection email/mail. They will mention that you will have to stop working by the time you receive that mail. And I hope when you say TR you are talking about your work permit. Just so you know implied status does not apply to IEC applicants (International Experience Holiday Visa).

2/ Working experience gained during your implied status is counted towards your experience, meaning it is valid, legally.

Why don't you call CIC and ask the same question just to make sure you are on the right path. Do not count on the words here. Call the centre and double check.

Hi,

1. Yes, you can work till a decision is made on your application. When I was in your position, I did the same thing and i sent them my AOR afterwards. They can also look it up on the system for you. I did write them a letter explaining my situation and asked them to look up the info on the system. But lucky for me, I got my AOR before they got to my application, so I just sent my AOR after I sent my application.

2. Yes, experience under Implied status counts, but it won't count towards your ongoing application. Your work experience or your application goes 3 years from the date you filed your application, so work done now won't count. If you were to apply again for whatever program, it will count but not for your ongoing application.

I think the OP has not yet applied for PR, because s/he does not have the one year of work experience yet.

Thank you for your reply. I did call the call centre to ask this question with two agents. However, I received different answers.
The first one reply back to me that as long as I submitted an application before the expiring date, then I will under implied status till the decision is made.
However, the second agent replied back to me that I need to stop working once the current work permit expires because my application is incomplete, the application is considered to have never been received, no implied status is granted.

Now, I am confused. But, I think the best thing to do for now is to stop working.

My case is kind different from yours. I have never filed my PR application. I was hoping this BOWP could buy me a couple of months employment. I might get invited in the next two rounds, but, it is merely possible that they receive my AOR when they process my BOWP application.

I'm pretty sure that you will be under implied status as long as you have submitted your application for extension before the expiration. You can always call for the third time and clarify this. Unfortunately the agents are known for being inconsistent with their answers.

Just checked the online info on implied status, which was updated recently -

Extensions
  • If the extension is approved, the date of issue shown on the document represents the date a decision was made. Observations in the remarks box of the document indicate that the applicant maintained their status, as per subsection R183(6).
  • If the extension is refused, the applicant is considered in status until the day the decision is made on their application.
  • If the extension is rejected (incomplete), the applicant is considered in status until the temporary resident document expires.

This does not sound good for people who apply for BOWPs without the AOR...
