Hello,

Since my passport will expires on Nov. 12th/ 2017 (Cannot extend anymore because of my home country military service problem), the time of getting PR is very valuable for me.

Here are my facts:
  • Came to Canada in 2005 with my mother & brother and I started high school.
  • Graduated high school in 2010 and went to US for university. (Studied Software Engineering)
  • When I was 2nd year in university, I went to co-op program (as Software Engineer) for 8 months in South Korea.
  • In 2013, because of financial crisis in family, I transferred to university in Ontario, York University. (Studying Computer Science)
  • Since March 22nd 2016 (one month ago), I found part-time job as Software Developer position. (It is a small company, but they do well in tax reports)
  • Because of lack of time, I am planning to change major from Computer Science to Bachelor of Science and graduate undergraduate degree in this summer as soon as possible.

Based on these information, ECE Express Entry is impossible, because I do need 1 year work experience after I get 3-years Post Graduate Work Permit on August 2016 (which is the month I will be graduated), then I will have 1 year work experience by August 2017. So, apply and wait for processing permanent resident in 1 or 2 months is not enough.

Thus, my question is am I able to qualify for apply FSW instead and get permanent resident before Nov. 12th/ 2017?
The work experiences such as Co-op (I am not sure Co-op counts because I have done that while I was in US university and it was about 4 years ago) and current job (manager told me he will continue to hire during this summer and after graduate as part-time/ full-time) only have done when I have study permit, I never worked with work permit visa (never applied).
1. Am I able to qualify to apply for FSW instead and get permanent resident before Nov. 12th/ 2017?
2. Does the work experiences I had before get the Bachelors degree counts? (I know ECE does not count the co-op/ work experiences that have done before graduating university, but not sure about FSW case)
3. I am working as Software Developer now, but changing major and graduate as Bachelor of Science (relating job) will be affected for reviewing by immigration officers?

Please help.

Thanks,

FSW also requires at least 1 year of full-time work experience to qualify, and if I understood correctly, you haven't fulfilled that yet either.

PS: Lots of South Koreans on this forum trying to get PR early to avoid conscription.
Thank you for your reply.
Yes, I already know that I still need 1 year work experience in FSW as well.
But I don't know if the work experience count since I was in study (study permit with applying for co-op visa/ off-campus work permit) or must be after I get Post Graduate Work Permit. (CEC only counts the ones after I get Post Graduate Work Permit, but how about FSW?)

Thanks,
You don't qualify for FSW at this time. FSW requires a minimum of 12 months full time continuous work experience, which it seems you do not have (your job in Korea was only 8 months).

Based on the information you provided above, it seems you will qualify for FSW and CEC at the same time, which is when you have completed a full year equivalent of part-time work in your current job.

Based on this it seems unlikely that you will be able to apply for PR and receive confirmation before your passport expires.

You should talk to an immigration lawyer though - there may be ways around the passport requirement if they force you to do military service, but I'm not sure about that. Talk to a lawyer.

Yes, work experience in the last 10 years does count for FSW, but you need at least 1 year of continuous work experience.

This means you can't add up your experience in Korea and your experience in Canada for the minimum 1 year requirement.

Sorry, I had deleted my earlier post. Looks already like Dexmoody got to explain it to you in more detail. It's just my hunch you may not get PR before your passport expires, if you still need time to earn the requisite work experience. Express Entry processing alone right now is taking about 5-6 months on average.

You could qualify for OINP Employer Stream if you can get a job offer as a graduate of York University, but again, that might take well beyond your passport expiry as well.

Thank you.

Then how about this case?

  • Just keep the Computer Science major and graduate on Dec 2016.
  • According to CIC, 1560 hours is one year. Now I finished one month of part-time work (23 days = 92 hours), will work full-time in the summer (about 85 days = 680 hours), work part-time in Fall (abut 80 days = 320 hours), and work full-time in winter (about 85 days = 680 hours), then 1560 hours will be satisfied before April 2016.
  • Then I am eligible to apply for FSW if I write language exam and have about more than 6 months to wait for PR process.

Will this one qualify for FSW?

1560 hours isn't enough - you also need to work 12 months. Any week of work where you work 30 hours or more is still only counted as one week of experience (even if you work 90 hours per week it's counted the same as a 30 hour week). You cannot count off campus work you complete while studying.

Also keep in mind that it greatly matters how many points you have under Express Entry. You don't just have to meet the experience requirements - you also have to meet the points cut off.
