Hello, I intend to sponsor my American partner in the future, who happens to be a transgender woman.

She has all of her documents (drivers license, passport, social security, etc) already changed over to reflect her new name and gender. However, there is a problem regarding her birth certificate - she can't change the gender marker on it. She was born in Ohio, and this state does not allow gender marker changes.

Obviously this causes some concern for us, as we are unsure if this will affect our future application process. I'm worried we may be denied due to the birth certificate being unable to reflect the proper gender. Is there any sort of document or information we should put into our application commenting on this? Everything else is corrected and updated except this, since there is not much we can do about it. She has only been able to change her name on the birth certificate.

Any help would be greatly appreciated!
 
I think it should be fine. Just explain the circumstances. A transgender person can get married in Canada, so it would not be a reason to refuse the PR application.
 
Include a letter of explanation. It will not be an issue.
