Question Regarding 38 occupations & My Case Ocupations (4122, 2171, 2174)

Friends I know this topic 38 occupations is being discussed for so long and I am late.. my analogies!

I just read on this forum at http://www.canadavisa.com/canada-immigration-discussion-board/new-rules-not-later-than-21-december-2008-t11480.50.html about 38 occupations list. And it says that "The eligibility criteria apply only to new federal skilled worker applicants". Occupations on my applications are:

* 4122 Graduate Assistant,
* 2171 Assistant System Analyst
* 2174 Programmer
* 2174 Assistant Web Developer

I don't see my occupation in new 38 occupations list. Buffalo office started processing on my application's on June 12, 2007. My Medicals, FBI & Banks documents were submitted in the last week of October 2008.

Would this new 38 occupations rule affect my case by any chance ? I read people talking about their applications returning because their occupation was not in new 38 occupations list. And I am worried about my case at this point.

A quick response will be appreciated.

hi all,

Please help, i have lot of confussion, if NOC 2171 is part of 38 occupation listed eligible for PR processing, i am a senior SAP consultant. with 7yr of IT experience .
i have found 0213(IT mgr) has sub code as 2171(IT consulatant )
but not very sure , since it is written as classifed elsewhere .
Please let me know if i have any chance for PR without an arrange employement.

The new 38 occupations rule would not effect for cases filed before 28 Feb, 2008 (they wont be fast track either).
