hello folks,

I just received FBI report for my wife. The report says search completed 02/10/2012 (feb 2012). me and my wife are currently in our home country and my return ticket to canada is on last week of april. My concern is since i am unable to file the sponsorship application until I myself is physically present in canada. would this FBI report still be valid by the time I submit the sponsorship application? technically how long can we use this fbi report?

My another concern is by the time my wife submitted FBI fingerprint request and by the time the report got mailed she moved to a different location. the fbi report we have has the old address. does this matter? anyone please help. i would really appreciate . Thank you!
 
The FBI clearance letter should be dated within 90 days of filing your application.

You do not need to be in Canada to submit your application. What you DO need to be able to do is provide a credible plan for your return back to Canada.

What matters is that the name and DOB of the clearance letter matches your wife. You can add a letter with your application explaining why the address on the clearance letter is not the address of your wife - show something that indicates it WAS (old bank statement, driver's licence, etc.) But I don't think that's going to matter much (since the Canadian government is actually quite capable of looking up people in the FBI database.)

Thank you so much computergreek. you have addressed some of my concerns that I have questioned more than 20 times on this forum. Every time I get a response back saying I wont be able to file an application unless I am physically in canada since i am a canada PR holder and not the citizen. I have been waiting to return canada to submit my application since 1st week of january. I really dont want to loose time waiting until my return . It would be really great if i can file my application right now. would you please explain how would i be able to submit my application. I dont have physical address in canada. I lived in toronto for a month in my friends place. now i am in my home country I have to look for apartment and a job once i return canada at end of april. will you pls let me know how can i submit my application while i am here so that i dont be wasting time. i would really really appreciate

You kinda left out the detail that you're a PR in your first post, it is relevant! You should at least be in Canada before they open your file to process sponsorship... So send it so it gets there before the FBI expires but be in canada ASAP.
 
Thank you so much awor so a permanent resident cant apply for spousal sponsorship from outside canada? i am not going to finish the entire application from outside canada but would be returning canada on end of april. Can anyone give me advise if i can do something during this time. right now i am doing nothing but waiting. pls help

You are returning to Canada at the end of April. By my calculations everything will be smooth sailing as long as you get that application in the mail and post-marked before May 10th. So shouldn't be a problem for you.

Thanks Rjessome, I got that. the FBI report has 90 days validity. I appreciate your reply. Do you think I can mail my spousal application package right now? I am out of canada returning only at the end of april. I really wanna save some time of processing if there is a way out. I have been waiting all the way from Jan this year just to return canada so that I can start applying. since I am out of country right now can i submit my package. ( i am a PR holder not citizen)

Are you currently LIVING outside of Canada or just visiting? If you are coming back to Canada to re-settle as a resident then wait until you get back (just being cautious). However, it you are just on holiday and your residence is IN Canada, then you can send it now.
 
At a minimum, you need to have a Canadian mailing address; of course you can change that in the future. Personally, I've always used a mailing service, for example, because I've always traveled quite a bit for work. But you REALLY want to make sure you are in Canada by the time they start processing your application (otherwise, as a PR, you aren't even eligible.) I don't have enough experience with trying to pre-submit it to say that's OK, but pragmatically speaking I'd expect that if you are in country once the processing starts, you should be fine. The safest thing to do is to wait until you are back in Canada to submit. I know a month longer sounds like a big deal, but if they reject your package, you'll have to go back and submit everything again anyway.
