Hello!!!

A few more questions. On number 28 of the IMM 5490 for sponsored spouse/partner questionaire. They ask 'Are you currently living with your sponsor'. I am unsure of this question because I will be in Belgium when the application is being sent through but I have lived the past year in Canada with my sponsor as common law. How do I answer this question? She never lived in Belgium it was the other way around. Also, for question number 29 'are you living with someone else other then your sponsor'- When I move back to Belgium I will be living with my parents again while we wait for approval. Do I write that???

welcome to the forum! and good luck in putting your application together.
To answer your question, it really depends on your situation. If you are going to Belgium for a visit (let's say a month) and then you return to Canada, and then live with your sponsor, then answer yes ( are you living with your sponsor) and add a separate paper where you explain that you have lived with your sponsor from that date to that date, and you will be in Belgium visiting your parents and intend to return to Canada ( on a tourist visa) to "visit" your sponsor and live with her after that.

If on the contrary you have lived with your sponsor, but now going to Belgium and not returning to Canada until your PR is approved, answer No - and attach a separate paper explaining when you lived with your sponsor, and when you returned to Belgium, etc.

If you are common-law, you need to prove that you have lived at least 12 months with your partner, and you should make it clear that it is a temporary thing, and that you intend to continue the relationship etc. If you have an idea of when you are returning to Canada, include it, so CIC can see that your relationship is continuing.

Question 29: answer yes - your parents, and explain the situation.

If you are applying outland, and you are from Belgium, you can still stay in Canada on a tourist visa in the meantime - the fact that you apply outland doesn't prevent you from staying in canada for 6 months, renewable ( if you are from a visa exempt country).
