Hi Friends,

I am in USA. and I am planning to enter Canada by road.I need to know when we enter Canada by road.Who stops us?Are we stopped by officials on the USA side or by the officials on the Canadian side.

When we exit USA.Do we get exit stamp in our passport from the Canadian officials ,who stops us at the border.

I have 1-94 in my passport because I came on Student visa long time ago .Am I suppose to handover that to the Canadian officials at the border? What else do I need to give to the officials.

Thanks,
Trick

Hello...Are you immigrating to Canada or just visiting?
In any case, you will be stopped by the Canadian Border control and immigration officers on the border. They will see your status in canada and guide you accordingly. USA has nothing to do with it when you are entering Canada. Both Canada and USA do not stamp exit when you depart either by road or flight.

Depending on your status in Canada - they might or might not do the entry stamp for Canada. They will just scan your passport and see your documents. If you are a US citizen then they will just scan your passport and let you in.

I am not sure about your I-94, I think US officers should take that back when you re-enter USA.

If you are going back to USA within 30 days after completing the landing formalities you do not have to hand over the I-94. While going back to USA, you can re-enter by showing your existing I-94.
If you are coming to Canada for good, you can ask the Canadian CBSA officer to take the I-94. They do not take it from your passport unless you ask them to.

Thanks vermanaman and gjp,

I am immigrating to Canada.

Currently I am on H1-b in USA and I also have got canadian PR.I will enter Canada to start my landing procedeure. I am not going
to return to USA any time soon.

I have to leave US. on or before 30th November to avoid any legal issues.I need to know about the exit or entry stamp in Canada. Those stamps will probably be the proof that I have exited USA as per the rules.I am asking all this because there is chance that I might work for same employer in USA.If I have some proof that I left USA when i was suppose to then I will not be having issues when I re-enter USA after couple of years.

Please advice.

Thanks,
Nitin Sharma

Since you are immigrating to Canada...i think they will ask you to go to the immigration office at the border to complete the formalities...they will do the entry stamp i think in this case. Again there is no exit stamp from US or Canada.
So you are saying that you will continue to live and work in US after doing your landing in Canada? In that case you will not have any problems anyways...just so you know, canada and US share border information...they will not stop you. They might ask you more questions about your residency in Canada though as per the PR obligation.

If you are staying in canada..and not moving to US...then there is no issue..Dont worry about the stamps. When you move to US later, you will have proof of your residence in canada...plus your PR landing documents...they will stamp entry when you do PR landing I think.

If I can be very sure that while entering Canada from Land,Officer will stamp my passport which will have date on it then I can be very sure that I will not have any issues. However,if that is not the case then I will not have any proof that I exited US.on time.

I will really appreciate If somebody who has been in the same situation in which I will can put more light on it.

I understand your state of mind...but let me tell you...it is not about your being sure it is about US and Canada immigration being sure...So as long as you see them scanning the barcode on your passport or entering your data in their system when you enter canada you can be sure. Again, I think when you do your landing they will stamp your passport...they stamped mine when i came as a student but I took a flight.

US and Canada share a lot of information ...if i were you I would not worry one bit....I have travelled between the two countries number of times, by road and air...they dont stamp my passport most of the times...but they know when i enter and leave because they scan my passport.

Do not worry. When you land for the first time, they will stamp your passport whether you land by air or road. The stamp on the passport will have the date.
