Hello I had a question about the position me and my soon to be wife are currently in .

My Girlfriend at the time had been denied entry to Canada after leaving Canada to visit some family, the boarder had told us they did not bealive she would be returning to USA on the date she was suppose to and that we needed to go about this different way if we intended to live in Canada and she was sent back to America.

I will be going to America to marry her in the next couple months and will be sponsoring a spouse (her) to be able to move to Canada to live I was just curious about what they said about proof of returning to America would she still need proof at the boarder that she will be returning if we are married and I am sponsoring her to move to Canada or would I just have to show the proof of Marriage and sponsorship and she would be fine .

I would just hate to get to the boarder with the proof of the sponsorship and they still wan't proof of returning to the states or would needing that information be out of the question since we are married and she is sponsored now .

The simple answer is Yes, she still needs to prove her intention to return to USA. Before her application would be approved, she is still a Visitor in the eyes of CBSA.

but if she's not going to be returning to the US should we wait for the application to be approved 1st and have all the proper information then she should travel across boarder and she wouldn't need to prove that anymore ?

If once her application would be approved, then yes, she doesn't need to prove her intention to be back to USA anymore. Instead, after her landing and officially becomes a PR, she needs to comply with the residence obligation, which is required to permanently live in Canada minimal 2 years of every 5 years, during her PR status, till she becomes Canadian citizen.

So basically I would have to go there do our marriage and file for a Sponsorship which would take over 6 months to process so In the mean time I should return to Canada myself and wait for the Process to be accepted and then she could travel herself across with the paper work of the marriage and sponsorship and should have no problems getting across. Or I could go back to her and come back together after everything has been accepted.?

If you are a Canadian citizen, you can go ahead live with her during the whole process as long as the US would allowed you stay. And if you are a PR yourself, you have to remain in Canada physically during the process. And for PA from US (US citizen or US PR), if your case is pretty straight forward and she had no history whatsoever with any law enforcement, the waiting isn't that bad, the whole process can be as short as 4-5 months. And once her application is approved, certainly that you can go there and accompany her to cross the border or she can do it by herself. With a COPR in her hand, the landing process is a piece of cake.
