So my wife currently has a TRP. She will be able to apply for rehabilitation in October (approximately 5 months or so). It will make 5 years since she was charged with a misdemeanor charge for shoplifting in the USA. She had shoplifted a $50 tank top from a mall and was not arrested but was told to appear in court and was given a $200 fine which she paid that day. Since then, she hasn't broken the law once and has been a model US citizen.
What I'm wondering is if we can still apply for spousal sponsorship and just send the rehabilitation when she gets it. We were all set to apply before we realized that she might be inadmissible. Her FBI clearance certificate came back clean but we didn't want to risk it so we applied for a TRP at the port of entry. We were also told to apply for rehabilitation at the port of entry because it's quicker that way.
I feel like it would be great if we could do most of the application stuff now and just wait for Rehabilitation and then send that over. The idea of waiting until October to get the rehabilitation then applying from scratch for PR and waiting 12 months (what the website says it takes to process) seems exhausting.
Any thoughts?
