Hello there! I hope you guys can help me with my question...

I am under a closed work permit since 2009 -low skilled- retail sales representative. Our company has 3 branches so we are like more than 20 in the company... But in the branch that I am working at we are only 3 people in the location. My concern is that if I apply for a supervisory position, will hrsdc question how many people in one location? because obviously if I will be a supervisor and we are only 3 in a store..who will I supervise right???

Is it right to just apply under a different branch and still continue to work in my location... since it's just one company, is that possible?

Please help! TY!

Hi, no, you can’t apply under a different branch. The LMO application must indicate the same branch where you’ll be working as a supervisor. To do otherwise is fraudulent. If HRSDC checks up as they periodically do, both the employer and you will be in trouble.

Hi you can only apply for the area you will be working, if you are also supervising other branches then you could include them otherwise it is fraud..

Can someone tell me how difficult it is to get a positive LMO? and also what kind of document that my employer need to put down for LMO?

The more specialized the skills required, the easier it is to get an LMO. However, the employer always has to advertise and prove why he/she tried couldn't hire or train Canadians for the job.

In terms of documents, usually nothing is needed beyond the application form, but HRSDC reserves the right to ask for additional documentation (e.g., proof of advertising, business registration, etc.) to aid in their decision making. If located in Manitoba, the employer must provide a WRAPA certificate (proving that he/she is in compliance with employment legislation).
