Query on dependant spouse's open work permit validity

Hi,

I am from India & currently working at Canada on ICT work permit which was processed by my Indian company. My wife has a open work permit (dependent on my ICT)which was processed by her employer. Both of our work permits are valid till end of 2016. Currently I have to go back to India; but will continue to work for same employer in India.

Can my wife continue with her job at Canada till end of 2016 ? Her open work permit will be valid even if I (primary work permit / ICT holder) go back to my country ? or is she allowed be stay & work in Canada only as long as I also stay in this country ?

This is a little bit of stretch and i am not absolutely sure. But a work permit once issued is not cancelled unless you have done something to cause deportation.

Besides, even if you go back to india, CIC has no way of differentiating if you are just visiting or you moved permanently.

Her issued work permit is valid till its expiry and she is fine to continue working on it.

Even if a closed work permit holder is laid off, he might not work for any one else. But he can stay in Canada till the expiry of permit legally.

If it was an open work permit, you are free to work for any one.
