Hello all,

This is not good.

Category: PRV for Wife from Thailand will live in Quebec
Applying: From outside Canada
CIC received kit: 29Jan2009
CIC status on 24Feb2009 showed in Process (yay!)

Now today, I just received a letter saying that I must send two more forms "Sponsorship agreement" and "IMM5481". Oh, and I think I would have to get an Option-C printout as well? These two forms clearly indicate that it is NOT required for Quebec resident. Does any have any clues on why I would need to send those? Is it because I am applying from Outside of Canada and they do not see me as Quebec resident? I am completely baffled.

Any comments or words of wisdom would be appreciated!

Hello all,

Let me narrow down the question and probably direct mostly to people who immigrated to Quebec. Did you have to submit "IMM5481" and "Sponsorship Agreement" to the CIC? Was it inland or outland application? Again, those forms clearly say that they are not required for Quebec Resident.

Please let me know if you have any experience with this Quebec specific case as I feel pretty much in the dark now (and am unable to get answers from CIC).

I am a Quebec resident and I sponsored my husband very recently. I contacted CIC on this a few times (spoke to differrent people just to be sure) and I was told to include all the forms with my application and for those that don't apply (since I'm a Quebec resident) to put "NOT APPLICABLE - QUEBEC RESIDENT" on the top. I checked them off on the checklist along with all the other required forms.

Thank you for your reply. I think that I was fooled by that "Quebec resident" statement. Because I am applying from outside Canada, and although I am planning to resume residency in Quebec and that I still am a Quebec resident for taxation matters, for CIC, I am NOT a Quebec resident.

Therefore, I would need to resubmit those forms - like for someone from another province. That's my guess. So the case of Outside Canada + going to Quebec is actually the one with most forms to submit!

Can anyone share their thought on this?

I'm not sure how that would work... if your intent is to live in Quebec than I'm honestly not sure if you need to submit all the forms regardless. I think if, when residing in Canada you are here in Quebec, but are just temporarily out of the country for now I beleive CIC considers you to be a Quebec resident (but just applying to sponsor from abroad... someone please correct me if I'm wrong). I am, however, pretty sure that you'll need to submit the 2nd forms to MICC after sponsorship approval, because you'll be residing in Quebec after your wife obtains her PR.

After your sponsorship is approved, you'll have to visit the MICC website to print out the Quebec forms and submit this to MICC along with a copy of your acceptance letter from CIC, proof of residency and your $250.00 processing fee. Ensure you fill out the french version (the english ones on the website are only there to aid you in completing the french forms).

Yes, for Quebec residents or those with intent to reside in Quebec do have a few additional steps and forms to fill out after approval for sponsorship but we do have less to complete for the initial package sent to Mississauga - I beleive 2 of the forms do not apply for Quebec residents (the sponsorship agreement, the sponsorship evaluation), which makes things slightly easier. In addition we do not have to submit proof of employment/salary, whereas those residing in a province other than Quebec have to do so in the sponsorhip evaluation.

What you have written is exactly what I have done (not submit these two forms IMM5481 and Sponsorship Agreement). So I am completely baffled by their refusal to continue processing my case. I also think there is no way for me to contact them from overseas which of course, make things pretty complicated.

I am currently in the process of gathering all the documents for IMM5481 (option-C, proofs of income, investments for item 17, 18, 19 of the document checklist). And I also agree that I would have to satisfy the MICC too. I think I have no choice but to abide to their request although I stay totally confused.

PMM, do you have any ideas?

jvhd, no reason to be baffled... I answered that in my original post.

You MUST submit these forms even though they don't apply. When I called CIC they said that I should include them when I submit my forms and ensure that I write "NOT APPLICABLE" at the top. They urged that I not omit any of the forms indicated in the checklist whether or not they applied to me (being a Quebec resident). This is exactly what I did - included the forms, wrote not applicable on the top as recommended & checked them off on the checklist so that none of the required forms were left out... so in essence they refused because they require the forms.

If that is the case, I don't understand the CIC logic. Anyhow, I am now waiting for my package to arrive as they said they have sent it to me as well. Hopefully it gets here soon then I can resend the whole thing with the extra forms. I think I might just fill them as they asked me to:

"Please sign, date and complete the Sponsorship Agreement between you, and the family member being sponsored"
and
"Please complete the sponsorship application (form IMM5481)"

I guess that way, they can't complain about anything?
And do you have any clues if they ALWAYS return the application package when a letter is requesting missing document?

Alot of people don't understand CIC's logic, but they're in charge and make the decision so we have to abide by their rules. Technically, they're not wrong for asking you to submit the forms. The guide does urge applicant's to include what is listed on the checklist and that, if any forms are omitted, the file can be refused and returned to you. They also mention plenty times throughout that they can, at any time, request further documentation.

As far as returning packages, I think it depends on the person handling your file - if they feel they require/need the forms, they will return it as they did with you. If they decide they don't need the missing forms, they proceed & approve.

Hang in there, provide them with what they ask and you should be alright.

Hi

I'm an American who was sponsored to Quebec by my Canadian wife.

It was not necessary for us to obtain an Option C printout because there is no low income cutoff for spousal sponsorship.

The sponsorship agreement is normally the portion of the application that is processed first. It goes to Mississauga for outland applications. After that, if everything is in order, the application goes to CIC to make sure there are no security or medical issues.

Quebec likes to give the impression that they are in control of the financial aspect of sponsorship. That's why you have to sign an undertaking and return that to Quebec. In reality if the application is approved at the federal level, there is 99.999% chance that Quebec will approve the undertaking. You just need to make sure that the sponsor is not in receipt of last resort social assistance (Assistance du dernier recours) at the time the application is filed.

Normally, the sponsorship agreement is processed first, then the application for PR, then the undertaking.
