Hi everyone!

I am an Irish citizen currently working in Canada on a working holiday visa. My partner is a Canadian citizen and will be sponsoring me for PR status next year. My working holiday visa expires in Sept, at which point I will have been living with my partner in Toronto for approximately 5 months. So far, I have added her as an occupant to my lease, we have set up a joint bank account which our rent and utilities come out of, and we have our internet bill in both our names. We both have our current address on our bank statements, phone bills, etc. so I think we have enough to prove cohabitation in Canada.

In Sept when my visa ends, I am planning to cross over to the United States and re-enter Canada on a visitor visa to continue living with my partner until mid Novemberish when we will then fly to Ireland and spend the rest of the year with my family. We were thinking for the time spent at my family's house, we could draw up a document signed by everybody plus witnesses to state that we were living there together for that period and then get it notarized. We would also have our plane tickets for the same flights for the duration of our stay in Ireland. Then in the new year, we are hoping to travel to multiple countries in Asia together until next May, which would mark a year since we began cohabitating.

Does anyone have any experience with couples proving common law status when travelling to multiple countries? We would be staying at shared accommodation together the entire time. All of our plane tickets would be purchased together and would be departing the same date and time. We were thinking of maybe creating a new email address that would be joint, which we could use to book all of our airbnbs, hotels, hostels, planes and trains. We could also use a joint bank account or credit card to pay for these accommodations and transport. We would have loads of photos to upload to the application as well.

Breakdown of cohabitation period:
May-November 2024 - living together in Toronto
November-December 2024 - living together with my family in Ireland
January-May 2025 - travelling across Asia together
June 2025- return to our place in Toronto and apply for PR sponsorship

- Photos don't prove cohabitation. Focus on actual cohabitation evidence such as joint leases, joint bank accounts, joint utility bills, etc.
- Don't flagpole to extend your status in Canada (unless you actually plan to spend time in the US to visit). Apply to extend your status from within Canada as well stating that you are working towards qualifying for common law status so that your partner can sponsor you.
- Agreed that getting married will simplify things significantly. Keep in mind that you have to show evidence of continuous cohabitation for common law. Cohabitation is more difficult to prove when traveling. Make sure both of your names are on all hotel reservations and that you continue to maintain and use a joint bank account.
