Hello,

I would like to get the following question clarified. I hear that you a limited to four years in Canada on temporary work permits. If you applied for permanent residency via PNP certificate and have been given a positive outcome on your application (AOR) and you apply for the two year visa via approved provincial nominee certificate will this visa be issued for two years or just until the duration of the 4 years working in Canada temporarily. Are LMO's also considered in the same category for this four year temporary work permit rule?

Yes if u approved you can get ur workpermit but its not compulsary that you will get two years work permit...its totally depend on visa officer that he will give you one year or two year workpermit

Thank you for your response.

I just wish to get confirmation that if you are already in Canada for almost four years working on temporary one year open work permits and that if you have your pr application submitted and processing you can still possibly get awarded another work permit via pnp or lmo so that you can work while your pr application is being processed. Or is that four years of temporary visa rule on for one class of work permit and that a pnp work permit or lmo work permit is considered a different class and does not apply to the four year rule?

You will get notify letter from CIC that says you can go a head to procces your Open Work Permit if you are waiting on your PR application to approve.

Provincial Nominees are exempt from the 4 year visa rule.

You will need to apply for your new visa on the basis of your pnp nomination and not via a LMO issued.

hi i_love_toast AND tee1,

not only provincial nominees are exempted from the four years limit but all permanent residence applicants that have already sent their files to CIC and received an approval in general email which is the AOR (acknowledgement of receipt) will be exempted from the four years limit.
just to add that you can either apply for BOWP if you have already submitted your application to cic and got file number,which will be issued for one year and can be extended later on case by case basis if your permanent residence application take longer then a year to be finalized.
or you can apply for a work permit tied to your employer based on a job offer and nomination certificate.
the difference is that the first work permit is open and you can work for any employer in the province nominating you while the second one is tied to one employer but in all cases you will not need LMO anymore.
good luck and worry too much about the four years work permit if you have already been nominated by a province,its just a matter of time to become a permanent resident.

Thank you very much canadavisa13 and tee1, that is exactly what I wanted to get confirmed. I actually have my application in since July on the CEC and have a BOWP, but I am also eligible for Alberta PNP via the Engineer route so just wanted to make sure that if someohow my CEC pr application was rejected down the line, I could get my pmp certificate and work permit and resubmit under the pnp class.

no visa will be issued for Provincial nominee certificate. but you can apply for a work permit, and they will only give 1 year. If you already have work permit then you can apply for a visa for single entry or multiple, and they will base in the length of you work permit.
