A month ago, I passed my Provincial Nominee application. But it was sent back to me (dated: March 30) it reads:

"the above-mentioned app. for provincial nominee under the Employer-Driven Stream of the AINP has undergone careful review. We have declined the app., as it has been determined that (the company that i work for) does not meet the eligibility criteria of the Employer Driven Stream"

" the employment offered to me is not considered permanent and full time. Information in the application showed that the employment has been less than 30 hours per week on atleast 5 occasions. This is considered part-time employment"

Where do i go from here?

1. Can i reapply even if there was a part there that said "the decision is final ; there is no appeal process"
2. If i can reapply- do i have to wait for 6mons to reapply of can i submit a new application right away.
3. I have a sister that also lives in AB. are there other alternatives for me to look at such as her sponsoring me.

Im really hoping for some help and guided advice from anyone..

Alberta use to have family stream, see http://www.albertacanada.com/immigration/immigrating/ainp-fs-family-stream.aspx but it is currently closed for new applications.

You should talk to the AINP to find out if there are other criteria that the company doesn't meet aside from the full time job. You should also ask how many hours on average they would consider full time (usually by immigration it is 1950 a year) and how long you would have to keep that average to be able to apply again.

Your backup option would be applying under CEC (as long as this is a skilled job). To do that, you would need 2 years and 3900 hours total. If you are working so little that it takes you longer to reach 3900 hours, that is ok as long as you do it in 3 year or less.

Just an update:

If this happens to you:

You can appeal, you can also re-apply anytime. My employer and I tried to appeal but AINP's decision was final. One should have 32+ hours a week to be considered as a full time employee.

I tried to watch my working hours, 32+ hours a week. We re-applied 6 months later. The 2nd application was fortunately approved ;)
