Providing work references/contracts from all employers?

Hi Guys,

I have a query regarding the requirement to provide references/work contracts,

It reads as though I am required to provide notorized contracts from all past and present employers, as with letters of reference, are they actually wanting these reference letters and contracts from every single employer.
Because what are you to do if say you do not have a contract , or that said business has since gone out of business?

Any thoughts would be appriciative,

Hi,

Yes, you need to provide references letters and contracts from all employers, however, it's pretty much known that companies vanish, go bankrupt, merged or else, hence don't worry at all. You need to provide written explanation for each case. CIC would be interested in the letters that are closely related to your NOC and for which you worked for more than a year in the last 10 years. For this one, make sure you provide it with no faults.

Please clarify a simple issue at which i am stuck since long and could not find a satisfactory answer uptil now. I am a mechanical engineer and have around 22 years experience. Now mechanical engineers dont fall in the mandatory 29 NOC's. However there exists an NOC 7316 (Foreman HVAC) whose job details match pretty much with what i have done in the past 10 years. Now as per your statement given above CIO / VO would be more interested to verify job details of my previous 10 yeras than the rest of 12 years. Thus as per your statement my NOC would be 7316. Is it like that or it is equally important for me to provide evidences of my intial 12 years experience irrespective of the fact that, my actual NOC of Mechanical Enginner is not included in 29 NOC's. I hope you understood what i want to know. please guide

This may not be a good news post, sorry. 1. NOC 7316 does not fall in the list of 29 IN DEMAND occupations posted below.
2. IF you were to qualify for FSW1 with an occupation in the NOC 29, CIO is only interested in what you have done in the past 10 years. If your qualifying occupation was in the list of 29, but you have not done it in the past 10 years, it would not be accepted. Check the current list and see if any of your previous occupations match NOC 29 jobs that have not reached 1000 yet.
3. There are certain places in the application where you WOULD be required to indicate what you have done in past years, for example, your Personal History from the age of 18.
4. If you are able to get a job offer and your prospective employer is willing to do all the required steps to get the offer approved, you may be able to qualify for immigration that way. HVAC certainly appears in the Employment Ads in local papers, so keep looking.

Yes, I got your point. You say you can prove you have at least one year experience in 7316 during the last 10 years, then yes, the reference letters for this NOC 7316 should be your primary objective. In fact, in the Schedule 3, CIC asks explicitly to fill for the first 10 years and for skill type 0, A and B:

'Starting with your current occupation, list your occupations within the 10 years preceding the date of your application. Give for each the appropriate National Occupational Classification code (NOC), the number of years of continuous full-time or equivalent part-time experience and a description of your main duties. List only occupations that fall in Skill Type 0 or Skill Levels A or B of the NOC.'

Agreed that you include all jobs that fall in category 0, A or B, but it still doesn't change the fact that none of his job duties are in NOC 29 occupations, or have I really missed the mark???
I do not see NOC 7316 in the list of 29.

You are right Pippin. I'm not sure which NOC Hasni refers to or he might be looking to 7216 instead.

I haven't looked at 7216, Contractors and Supervisors, Mechanic Trades, but hope HASNI will do so and see if his job duties are reflected there as well.

I am extremely sorry that i put the wron NOC in haste, its actually 7216 (Mezo you anticipated it right).
Mezo i understood your reply. So its mainly the past 10 years from the date you apply.Does it also mean that if due to some reasons i fail to provide the reference letter / job contract of my intial 12 years, would not have any adverse impact on my application and we should not bother much about that part of our job experience!!!

Just want to know what if you have a job offer (AEO) which is approved, will the Visa office/officer still raise eyebrows if you dont have the reference/experience letter?

Yes, I've done it. Not all employers sign a contract with employees. Contracts are commonly replaced by offer letters or appointment letters, and once these are signed by both parties, they become legally binding. Each country has its own legal and labour laws and contracts are not necessarily part of it.

Just submit what you have and write an explanation letter.
