Proof of funds / home ties for SOWP

Hi Guys,

I have a few doubts regarding SOWP. Request you all to share any knowledge that you might be having in this regard.

I am an international student and have completed half of my course. I recently got married and am trying to apply SOWP for my wife. My concerns are:

1. My dad would be transferring around 10 Lakh INR(~20000 CAD) for proof of funds to my wife's account. Therefore there would be a spike in my wife's account balance. Is it a OK to do this?

2. Do I have to wait for 6 months and then take an account statement for proof of funds or would a balance certificate be sufficient?

2. I am also thinking in terms of getting a gift deed from my dad. Would there be an issue due to this? I read about it for proof of funds for PR. Would it also be applicable for financials for SOWP(would there be any hesitation due to this?)

3. Do I have to provide 6 months' account statement or 3 months would be sufficient?

4. For home ties, I am planning to get our property evaluated by CA and submit the document. Our house is on my dad's name, would it be accepted as a proof of home tie for my wife(I am the only son for my parents).

5. My wife is employed in a leading IT company. But they do not provide sabbatical. Is there any other way by which I can show home ties. There is no property on her name.

6. Do you suggest that I go in for a student visa and then possibly apply for a change of status? I am not planning for a TRV as most of them who are applying for TRV are getting rejected.

I have read a couple of threads regarding this financial thing but still things are a bit hazy. Please suggest. Appreciate your assistance!

Have a great day!

I'd suggest that you submit bank statement for the preceding 6 months after the transfer of funds from your father. Please include an explanation for the spike together with a gift deed from you father. Also, include your father's bank statement showing the outgoing funds to tie it all together neatly.

Another option might be to have your father transfer the funds now and wait for 6 months to submit the bank statement so that you don't have to include the explanation. The obvious disadvantage would be the long waiting time.

This property would show your dad's ties. Perhaps an inheritance deed might help. But I'm not sure.

Would the IT company be willing to provide a letter that they will consider your wife's re-employment upon return from Canada? Also, your wife's ties would include her relatives in the home country.

Do you mean a student visa for your wife? She will need to gain admission in a designated learning institute in Canada before she can apply for the visa. Also, she will need to demonstrate sufficient funds for her tuition and cost of living for the duration of the course.

I recommend reaching out to fkl for guidance on this subject. I am not sure if he will review this thread, but you may pose your question on the thread called 'Spouse Open Work Permit' which has approx 231 pages. Please address the question to fkl so that you gain his attention. He is a very knowledgable and helpful person.
