Hi everyone can someone clarify to me.

I have the PR and I'm want to take my Brazilian dependent son (5 years old) to Canada I'm also issuing his TRV, I never married his mother and we no longer being a couple for at least 7 years ago, in my son's application is asking about custody, but neither she nor I filled any lawsuit, she has already authorized his trip by letter also notarized, can I continue the application without proof of custody? in the TRV application there is no form 5604, it will give me problems on the borders?

Do you have legal custody of the child from the court?

They never filed any lawsuit so there is no proof of legal custody.

In that case, the best course of action (if you are on good terms with the children's mother) would be to draft a custody agreement with a lawyer, get it notarized and show this as proof. Also, it's good to have authorization from his mother for the travel to Canada with details (like from when to when with whom the children will be spending time etc) as this is more for CSBA.
