Proof of Custody?

Hello

I am a Canadian citizen sponsoring my wife from Sweden on an outland app.
Does anyone know if my wife needs to show proof of her "shared custody" of her children, even if they will be non accompanying at this time?
...or is it only if they are accompanying dependents?
Does she have to have sole custody of her dependents to sponsor them at a later date?
Does her ex husband (and/or the courts) have to give her permission in writing to acknowledge that he approves/gives her permission to have her children leave Sweden for Canada

I don't think they has to show proof of custody, or permission, yet . . . as long as they are going to be listed on this application as non-accompanying. However, they do have to undergo the medical exam, etc., anyway, this time. When she applies to sponsor them at a later date (which will require a new application), she will need to either show that she has full physical and legal custody (with no visitation for their father), or she needs him to give notarized permission for them to immigrate.

Just a note - depending on how long from now she intends to sponsor them to come to Canada, you might consider listing them as accompanying dependents on this application and doing everything all at once. They could then come to Canada to "land" when the PR is approved, and return to Sweden to stay for up to three years . . . as long as after that three year period of time they come back and stay in Canada for at least two years. The residency requirement for maintaining Canadian PR is 730 days of each 5 year period . . . or living continuously with the sponsor if (the sponsor is) in another country.

My husband whom I am sponsoring has had his daughter since she was one yrs old and is now 7 yrs just went throught something what you are going through. You only need to show proof of custody or approval from other parent if she is bringing the child to Canada otherwise just list the child on the application. When the time comes to sponsor the child at a later date your wife will need a letter from the childs father giving her permission to bring the child to Canada. This letter needs to be signed by "The Justice of the Peace" or equivalent in that country. Also the father would have to send along with the letter to your wife a copy of photo id with signature to prove the signature in the letter is the same person. When sponsoring the child your wife needs these documents to send with application and the father will have show these documents when applying for passport for the child. The child will need the passport to get a medical done for the application.
