Processing my PR and my husband's work permit at the same time

Hello,

I am in kind of a difficult situation. I have a open work permit (for Canada) till October 2017, and therefore am aware that I need to apply for PR ASAP. I have cleared CELPIP as well.

My husband is currently in India and his tourist visa and open work permit (applied directly from India), has been rejected. (It could have been because of my employment situation when we applied and when the visa decision was received were different). Also, due to personal reasons, I want to apply for his work permit and my PR separately (I am wondering if I can do that, and not include him in my PR application). I am not sure if his history would have an affect on my PR.

Different people are advising me different things - some say it is possible, some say it is a case of dual intent.

Please advise.

You have you include him in your PR application since you are married - but you can flag him as non-accompanying (meaning he won't be coming to Canada and won't be issued a PR visa when you are). Regardless of whether you flag him as accompanying or non-accompanying, he will have to complete the medical, provide PCCs and pass the background / security checks in order for your PR visa to be issued.

Thanks, that was very informative....Also, while I process him as non-accompanying, can I simultaneously apply for his work permit ?

Also, will his profile (his work experience etc) and his rejection history, affect the decision made on my PR ?

Yes - you can apply for his work permit.

I'm not sure why you would flag him as non-accompanying in your PR application. It means you'll have to complete all of the paperwork again when he's ready to come to Canada. If he has any plans to come to Canada, he should be listed as accompanying.

His history will have no impact on your PR application.

Yes, I can include him as accompanying.. I was just a bit concerned due to personal reasons..

Given the first OWP was refused - there's a good chance the second one will be as well. However you can certainly try again.

Whether you include him as accompanying or non-accompanying in your PR application won't impact the OWP.

I think you will be creating complications for yourself and your life if you flag him as non-accompanying. But obviously your choice.

Thanks a lot... Ya I think I will mark him as 'Accompanying'..

The overall processing time for PR is a minimum of 6 months, correct.. ?
