Procedural Fairness Letter - Intent to leave Quebec

Hello,
I have applied for Permanent Residency in CEC from Quebec. I received a "Procedural Fairness Letter" letter earlier this week asking to provide proof of intent to leave the province of Quebec.

- I am currently on a closed work permit only applicable for Quebec.
- Our current rental lease is in Quebec.
- My spouse who is dependent in my application recently started a job in Toronto, Ontario. We have not claimed any points for this experience in our application.

Can we use her job application/offer letter as sufficient proof, or should it be in my name? My main concern is that as the proof is only on the dependents name and if that will be an issue? Kindly advice.

If you are the main applicant, then you are the one who has to show intent to live outside Quebec not your spouse. So respond to the questions asked with proof you are not living in Quebec or will not live in Quebec in the very near future.

This a PFL so you want to show everything you have to show that you are leaving Quebec. What proof do you have?
Hello, the only proof I currently have is the job offer for my spouse. I will be planning to get a new lease within this week for a house in Toronto which can then become my main proof.

I am currently on a closed work permit valid only for Quebec. I don't know if I should my cancel my current lease in Quebec and if it will cause legal issues for my employment.

I don't have issues in keeping both leases as well, but will that cause additional issues/questions from IRCC?

Your wife’s job offer is not considered if you are the main applicant. You need a lease with your name on it including utilty bills in your name and/or a driver’s license for Ontario.

That's unfair. Somebody from Quebec already received their PR. They never mentioned any "Procedural Fairness Letter - Intent to leave Quebec". Do you see any red flags on your file that might have led to this? A permanent job (open-ended or indefinite contract) or something like that?

I understand that, but I am trying to understand the reason behind the difference between vinayvarshney's case and the case from the other thread. Type of work permit doesn't seem to be a reason for this letter. However, if the type of job is permanent, that's a different story.

Well I had submitted an intent letter to move to Ontario and leave Quebec with my application, but without any evidence. I had also furnished an official letter from my employer that my current contract will end in Sep 2021 (it has now been extended).

I had written these letters on my own so it maybe a case that I was not able to convince IRCC entirely.

My two cents . Try to get a letter from a friend/family confirming that you will be staying with them and they help you settle down. Bring in language issue or to continue children's education on english medium school. Also, if you ever applied a job casually through any job portal , it can add some value.

How will getting a letter from family/friends prove intent to live in Ontario with PFL. Need proof. Lease in Ontario. Utility bills, taxes, driver’s license, job etc.

I am also currently a Quebec resident with a closed work permit. In my case, I have applied for about a dozen jobs, but the companies always ask a question about the "legally allowed to work in Canada" which I always answer No (given my circumstances), so I never get the job. Probably the companies don't like to get the "LMIA headache". If I ever get this "Procedural Fairness Letter - Intent to leave Quebec", I plan to provide all the job application receipts and copies of applications that I have sent to all the employers. Common sense should be that to survive in Ontario, one needs a job there. If you're working on an employer-bound work permit, you can't really quit the job you already have or move to Ontario just to prove that you don't intend to reside in Quebec. And who is to hold you from coming back after obtaining PR? Or they should disqualify the experience gained in Quebec in the first place to save themselves and the applicants some trouble.

In fact, if we take this seriously, they don't want any ties with Quebec. This means, no leases, no jobs, no driver licenses, no kids in the schools, no spouse working in Quebec, no nothing. If you keep the two leases they are definitely coming back to you with that again :D and ultimately, they'll ask you to quit your job because your employer is Quebecer, and being on an employer-bound work permit, you're no longer legally allowed to stay in Canada the day you quit, hence you become an outland PR applicant loll

I think it all depends on the case processing offer. I have seen people's PRs getting approved while residing in Quebec during the processing of their PR applications and even after the granting of PR.

So, my suggestion is to consult someone specializing in handling these types of matters legally. Or otherwise, make a simple and logical explanation about job searching, job rejections, language issues, and others that could support your claim that you really are trying to exit Quebec sooner or later but it depends on the factors beyond your control.
