Hi,

Regarding proof of employment and reference letters from previous employers, I have all the reference letters almost in the same format as CIC requires with salary information, job description, dates etc. Fortunately, I also have old business cards of my boss and the HR guy who had signed the letter. My problem is that the company I used to work for, does not exist any more as it is more than 5 years before and the contact information on the letter head and business cards might not be valid now. The crucial thing is that the 1 year experience for the position of "software development manager" (0213) which makes me eligible to apply under the FSW Cat 1 (new 38 NOC list etc.), was with the company that does not exist anymore.

I know I can write a cover letter to explain this and I also have the payslips for that period too when I worked for that company as manager but what are my chances of getting rejected because of the reason that CHC cannot verify my work experience with that company. I may have some of the tax return documents though but not all of them.

Although, my engagement with all future employers after that was with big multinationals (9+ years of experience) who obviously do their background checking before hiring anyone and they must have done that for me also....any comments? feedback? ideas? specially from all the senior fellows on this forum? Rupeshhari? I would highly appreciate.

Remember a senior person (like me) in this forum is someone who makes a lot of noise, it does not mean my answers are accurate. They are mostly suggestions based on what I read here and CIC website. At least, this is true for me. I have only made one application (that of mine) and who knows, it may not even be successful. You should PM helpmeimmigrate and BCGuy and ask them the same question because they have experience with immigration and CIC.

I am not sure sure how your situation would work.

Is your the work experience you are claiming for your ministerial list, experience in the last 10 years?

Anyway, maybe i am misunderstanding what you wrote below so will assume that you got your ministerial job list experience in the last 10years.

Can you get a letter from your employer who employed you straight after that company to say why he hired you (i.e. based on your IT managing experience from that company that does not exist anymore and that he is writing this letter because he knows that company does not exist any more). I don't know if this will work even, i am giving you suggestion. I have no experience with something like this. Lets see if other people on here can come up with some good suggestion.

I understand that you are just like one of us and are only sharing your experience. I also do understand that your application has not been accepted yet but your comments are quite often very logical. I guess all of us on this forum do appreciate your noise. Please keep on making more. Since I have only had interaction with a couple of guys on this forum. I don't know who is more knowledgeable and senior and who is not. Thanks for letting me know.

Thank you Rupesh, for those kind words but I guess we all learn from experience and I am sure you aplication will be a success.

Well, getting a letter from the next employer would not really help much in this situation because what the CIC is loooking for is if the company you worked for is genuine or not and another company though can say that for you but would CIC belive them or not, is really up to them.

My suggestion in this case is based on the type of company you work for, is it a private firm or a multinational. Looks from your post that it was a private owned company which is fine because that explains why it does not exists anymore.

What you could do is, first of all make sure that your experience letter is gud, like it has your duties and job profile in sync with the NOC code you are eligible under which I guess in your case is 0213.
If this is ok , and you have business cards for your boss and HR person, you can include the letter.

To let them know of the fact that the company is not in existence any more, you may provide a personal reference letter from the owner/ manager or boss from that company, stating what your title was in the company and how long you worked and that the company is now close, you will have to get the letter notarized for validity.
You may also get a few more such letters from co workers who worked with you in the company stating the same thing. These letters do not need your job profile, just need to state that they worked with you in the same company which is no longer existing.

And in your cover letter, when you explain what NOc code you are applying under , mention that the company is closed due to ________ but you are providing all required documentation that may be helpful to CIC in determining the genuinity of the job.

I guess that answers your question.

Thanks a lot helpmeimmigrate. It is really helpful. Infact, upon further investigation on my previous company, I found out that it does exist and they have shrunken their operations a lot and might be only a couple of people running the company now. Since I don't live in that country anymore it was difficult for me to go physically to the place and ask more. Anyhow, I found out about it through some ex-colleagues in other countries and now I am trying to see if the person who signed the letter is still with that company or not.

By the way, just in case if that HR person is no more with the company, what additional things do you recommend that I should provide to CIC? Can I provide the business card of someone else who is currently there but with the old reference letter signed by the previous HR person? It would be very difficult for me to get those reference letters again signed by new boss. Although, I can get a letter from the current owner of the company saying that this HR person does not work with the company anymore. I guess that would make the CIC believe that all documents are genuine. I guess I need to do all this ASAP before that company goes bankrupt.

The reference letters that I have are dated 4 years back. I hope the CIC does not require reference letters that are newly dated?

I agree with the above advice a personal reference letter is good and document from the local company registry or its equivalent which shows the company existed and is now closed
