Hi everyone,
I am writing on behalf of my friend.
Previously obtained Canadian PR but came back to Malaysia in 2012 for baby delivry. Applied forPRTD in Jan 2016 but refused and applead. Then according to lawyers advise, my hubby ( whos in Cananda and PR )is sponsoring me n my kid.
So the PRTD appeal was withdrawn. Sponsor approved met the requirement andnow requested topay for PR payment.
What will happen next?
Do I still have to surrender my PR card?
Thank you

It sounds as though you are still currently a PR. You will need to wait out the process of them removing that PR before the spousal application your husband launched can be finalized.

It is my opinions that you are no longer a PR.
You didn't comply with 730 days requirement. A refusal of a request for PRTD is a decision that you breached the residency obligation. You had up to 60 days to file an appeal because it was a decision made overseas. Withdrawal the appeal was a decision on giving up appeal, which means, the original overseas decision withheld.
Therefore it was the uncontested final determination on your PR status.

For other circumstance, a person needs to file applicant to renounce their PR status.

What exact date did you withdraw the appeal, and what exact date did your husband submit the new app to sponsor you under family class?

As mentioned, you need to make sure your PR status is officially revoked in the CIC system before any new PR app is submitted.
