Hello,

Im Rani Jacob a PR holder of Canada. My son Aaron K Shajan became a PR of Canada in november 2010.
He stayed in Canada until 24 th April 2011.And he left for India. He is still in India and is coming back to Canada
by April 2014.Will he be able to enter Canada without any issues or do I need to do something to maintain
his PR status, since he was staying outside Canada for a long period. His PR card shows the expiration in January 2016.
If it can create issues during his landing what can I do to prevent that and what should I do for the same.
Also kindly let me know where can I do all these processings. Kindly help me with this query.

Thanking you

Rani Jacob

You shouldn't post your full names here. If immigration is reading this, you bet they are posting a flag on his file right now.

Truth to be told, the limit he can be outside Canada as a PR in his first 5 years or any rolling 5 year period after that is 3 years. If he left on April 24th 2011 and will be back before April 24th 2014, he has nothing to worry about. When he is asked upon entering Canada how long he was gone, he will say less than 3 years. They may ask him why he was gone so long and if he realizes that he has used up all his time allowed outside Canada. He should say yes, he realizes that and is back to stay for good now.

In order to keep his PR, he then has to stay in Canada until he has his 730 days in past 5 years and then he can apply to renew his PR card. In order to continue to meet the RO for the rolling 5 year period, because he will have been gone for almost 3 years, he needs to fulfill 2 years straight to make it up. He should therefore not leave Canada until April 2016 at the earliest.

You can do nothing to help him keep his PR status. He just needs to make sure himself that he continues to meet the RO.
