Hi there,
I have a PR status(since June 2008) and live accompany with my Canadian family(spouse and kids) ouside Canada, although I come every three months for 10 days for some business, never been questioned in the airport...Do you think I need to be worried about I am being outside more than being inside and that means I break the PR rules?! that would cause revoke my PR any time ?!

Thanks for reply in advance..

No, you didn't break the rules. So long that you are with your Canadian spouse outside Canada.

As long as your spouse is a Canadian citizen and you are living with your spouse, you can keep your PR indefinitely. Make a note of when you are in Canada because you will need your travel history when you apply to renew your PR card.

Well,
What do I answer the custom officer If for any reason He asks me where have you been ? because I used to answer ( if I got this question ) that I was outside for couple of weeks for business trip..! just to stop the argument and hassels!!! do you think I do the right thing or I must not do that ?!

Thank you so much for reply :0)

It is ok to say that you live elsewhere with your Canadian spouse. A day spent outside Canada with your Canadian spouse counts as a day in Canada for your PR.

Thank You for your quick response ...

1- But is it wrong what I do when I answer that I was outside for short trip , it's just to avoid the hassels !!!
2 - I plan to back to Canada for good ... Do I count the days from the landing or from the final move ?

Thanks again everybody...

Lying to immigration is always wrong ;)

You need to meet the residency requirements in your first 5 years as a PR and each rolling 5 year period after that. When you apply to renew your PR card in the future, you will have to give them a breakdown for the previous 5 years how many days you were in Canada, how many days you were outside Canada with your Canadian spouse and how many days you were outside Canada and not with your Canadian spouse.

Hi senabib
PMM is rightly saying to you that you are safe even being outside so long as you are married to your Canadian spouse.
In other words you don't lose any days

I have another question to the expert 8)
What If I apply for the citizinship after completing three years, what is the possibility to get it approved ?
I have everything in canada (house, mobilephone, bank account,pay my tax ,monthly income,every thing) exept my passport shows the stamps !!!
Thanks

@Sen.Habs
Take Leon advice ,Lying to immigration is always wrong.
The residency requirement rules are established to prevent people from abusing the concept of Permanent Residence.the exceptions are the cases where an individual residing outside canada is:
1)Accompanying his canadian spouse residing with him/her
2)Working for the canadian Government while posted abroad for that puropse
3)Working for a canadian Company while posted abroad.
In your case the only days you would lose are those spent outside Canada without your spouse, other than that still fulfill the residency requirement for PR .

Citizenship requires physical presence in Canada for 3 out of the previous 4 years. If you are living outside of Canada with your spouse and don't meet that requirement, you are not eligible. Your passport is part of the proof you must submit so you have no chance of being approved in your current circumstances.

@Sen.Habs
One way to be sure is to make enquiries with CIC in Canada ,they are the best people to tell you where you stand. I also think you will find it hard to prove residency requirement for citizenship if you have been outside Canada most of your PR time.
