Hey all,

I posted this in the Temp Entry topics as well because I wasn't sure which category best fits this scenario.

Here is the scenario;

Married couple living in the USA (husband in CDN) are looking to move back to Canada. Wife (US citizen) is expecting a second child in about 7 months time and their main concern is having OHIP when they move back.

They can apply outland or inland but would prefer outland because of the faster processing times and flexibility with regard to travel. Wife will not get OWP (and then OHIP) with outland. If they apply outland, is there any way for her to get a work permit as well?

She may have a job offer from a relative here who owns a large company but they do not know how to get a LMIA and probably will not want to be bothered with it. They would hire her as a graphic designer or interior designer. She has certificates in graphic design and interior design from a post secondary institution but only has 2 years work experience.

1) Is it possible to do an Outland application and also get a work permit?
2) Can she apply through NAFTA?
3) Should she try at POE?
4) Should she include WP application with their PR application?

1) Yes. She can get a CLOSED work permit with a job offer in Canada. An LMIA will be needed as well if the job does not qualify under NAFTA.
2) Yes - if she qualifies.
3) Yes - once she has a job offer and an approved LMIA (if required).
4) No - definitely not.

See here, explanation of and jobs qualifying under NAFTA: http://www.canadavisa.com/nafta-work-permits.html

Seems Graphic and Interior Designer are on the list, so with a job offer in hand she should be able to get the closed work permit at any POE with proof of her credentials and 2 years work experience.

Thanks Rob. I understand you must ask for a Nafta WP at POE? I guess you bring the signed job offer along with credentials (degree/certificate) and perhaps proof of previous work experience/employment. Is there anything else they might ask for at POE?
