PR Returning with non Canadian Baby

Hi all,

Does anyone know the procedure for handling this situation.

PR has a baby out of Canada (non Canadian father) and wishes to return with the baby to resume residence in Canada, her residency status is fine. The baby has a UK passport.

You need to sponsor your child. As a PR, you must be in Canada throughout the sponsorship process. You can bring the baby with you as a visitor but depending on the province, may not be able to access provincial healthcare for him/her during the sponsorship process. It generally takes about 6-8 months for child sponsorship.

Is the other parent Canadian citizen?
You should talk to a Canadian immigration/consultant lawyer first.
Baby with UK passport is allow to stay in Canada 6 months, then you might apply for an extension.
This is a simple situation with no need for a lawyer or consultant.

Thanks for that, a couple of other questions;

1) On entering Canada the baby will have visitor status but obviously will be intending to stay permanently, is there any chance however remote that mother and baby would be refused entry ?

2) Also is the sponsoring of a baby essentially just an admin exercise or are there reasons the sponsorship could be declined?

1. As a PR, the mother can't be refused entry. CBSA is not in the habit of splitting up babies from mothers, so they are not going to refuse the baby entry.

2. There are the normal reasons that any sponsorship app can be refused, such as undischarged bankruptcy, previous sponsorship default etc., but other than that, it will be approved.
