Hi all,

My situation is,

I'm have got my PR in 2008, however ive never lived there and has been working in somewhere else for the last 3 years. According to the law, it says to keep the PR we need to be in canada of at least 2 of the last 5 years from the date you got the PR.

What im asking now is, is there a way for me to delay this, as in I go there in 2012 (4 years after taken PR) instead of this year 2011 (Exactly 3 years). Will i still be able to keep my PR?

It is possible that if you want to go to Canada in 2012, you will slip in unnoticed. They do not always have the data available to see how long you were gone unless you tell them. If that happens, you could keep your PR if you stay in Canada until you have the 2 years. At the time you apply to renew, they will only look at the 5 years previous to your application, not your first 5 years or any other 5 year period. If you have 2 years in Canada during that time, they will renew. That would mean that you would have to let your PR card expire but that should not affect your daily life in Canada.

If they pick you out on your entry to Canada and suspect you of not meeting the residency requirements, they will do a residency questionnaire and in that case, you have the option to appeal but unless you had a good reason to be outside Canada, taking care of a sick relative for example, you don't have good chances of winning the appeal.
 
where can i get this assurance from? is there anyone i can see or talk about this?

I want to work longer in my current work place (another 1 year so total of 4 years)

Please help me guys. quite urgent :(
 
No assurance. If they pick you out when you enter Canada and you either admit you were gone for 4 years or they ask you to prove that you have lived in Canada for at least 2 and you can't, your PR is gone. You can appeal but like I said, the odds of winning an appeal unless you have a good reason are low.
 
Sorry ya just to clarify :'(,

So basically 5 years from 2008,

If i go during 2012, there will be only 1 year left for me.

If i go during 2012 and stay till 2014. It will still show i have stayed in canada for 2 years ya.

My pr will get expired, but in 2014 i can renew it. Am i right?

What are the consequences?

Yes you are right. The consequence is that once your PR expires you will not be able to travel out of Canada until you renew it again in 2014.
