Dear All,

My spouse is a Canadian has sponsored me for PR and we have just received an email requesting my passport. We also have a baby who is a Canadian citizen. I was wondering whether me staying with my wife outside of Canada (we work for different international organizations in the same city) counts towards my Residency in Canada? I have read that accompanying a Canadian spouse abroad counts towards the 2 years in 5 requirement but I am confused whether this only applies if the spouse (Canadian citizen) is on official government/Canadian business duty abroad.

All help regarding this matter is very appreciated.

Living with your Canadian spouse abroad counts towards the 2 out of 5 year requirement for PR (but not for citizenship). It doesn't matter what your spouse is doing (can be unemployed or whatever), the only thing is that you live together.

As has already been stated, the PR RO covers this situation. However, if your spouse cannot prove that she will return to reside in Canada once your PR is granted, expect a difficult time and a potential refusal.

Thanks for your responses. We definitely plan on moving to Canada and for our daughter to begin schooling there as she is also a citizen but we want to ensure that we both secure decent jobs (much easier for my wife obviously) and don't rush into a cycle of random jobs necessary just to pay the bills. I was hoping that we use the next years while our child is still a baby/toddler to visit Canada often so that we can transfer our resources there, buy property and have me establish networks/contacts so that I can seize a decent opportunity once it appears. We both work for int'l organizations, don't own any property in the country we re in and have no intention on settling here.

I guess the proof the spouse has to show for wanting to move back to Canada is similiar as in the PR application?
