PR renewal requirements

Hello guys,
Please help me with this problem. I am so worried.
I became a PR (landed) on June 29 ,2014. However, I did not receive my PR card after 6-8 weeks ( as they claim it is the usual time to issue PR card). Due to personal problems, I left Canada and returned to Canada again in 2016 by travel document. This time, I could get my card and left Canada again after 60 days and never returned.The expiry date on my card is 20 July, 2021. My question is can I return to Canada only 2 years before the expiry date to be able to meet the residency requirement and renew my PR card? Am I allowed to enter Canada if I plan to go next year ?

You are in violation of the residency requirement which means your PR status could be revoked.

The date of your PR card expiry is irrelevant. What matters is when you landed and became a PR. From the late you landed in Canada and became a PR, you must live in Canada for a minimum of two years. Based on the information you have provided, you're already in violation of the PR residency requirement since you've been outside of Canada for more than three years since you landed and became a PR - this puts you at risk of losing your PR status. If keeping your PR status is a priority, you should return to Canada as soon as you possibly can and then live in Canada until you meet the residency obligation.

The longer you wait, the greater the chance you will not be able to keep your PR status.

Thanks for the reply. Based on what you just said, I haven't met the requirements already! So how can I make sure that if I plan to enter Canada they don't stop me at the airport?! Of course, I plan to go and live until I meet the RO. But, I don't wanna leave my job and life back in my country to be simply rejected in Canada! The question is they prevent me from entry or when I want to renew my PR they revoke it? Thx

They won't stop you from entering Canada - however it's possible you may be reported at the border for failing to meet the residency requirement. If that happens, you would have to appear at a hearing to argue why you should be allowed to keep your PR status.

There is nothing you can do to guarantee you will not be reported. You may be reported or you may not be. The longer you wait to return, the greater the chances you will be reported.

You probably should have considered that before applying for permanent residence and made the effort earlier to remain. That's why it's called "Permanent Residence"....you are suppose to settle in Canada permanently, not just when you feel it is convenient. You had the opportunity in 2016 (essentially you got a free pass then to meet the RO) and you choose not to.

If you do manage to get back without being reported, keep in mind that after 2019 you need to have 2 years at any point in the past 5 years....it's a bit tougher to maintain that if you aren't settling permanently

Since you've spent more than 3 years outside Canada in the 5 years since landing as PR, you are officially in violation of the RO. There is nothing you can do to guarantee your PR status won't be reported and eventually revoked, upon your next attempt to return to Canada.

The only thing you can do is make the attempt, and see what happens. If you return to Canada before your PR card expires, there's a chance CBSA may not notice your RO violation and will allow you in. If this happens, you must then commit to staying in Canada and not leaving for any reason until you are back in compliance with the RO.

If you are reported, then you can choose to appeal it (which can take a couple years) or just accept the termination of your PR status and go back to home country.
