My wife is approximately 90 days short of her residency obligations for pr renewal as she was the only daughter and she does not have a father or any siblings and so had to take care of her 86 years old sick mother in her country, so for the first 3 years, of her permanent resident, she is use to stay only 3 to 4 months with me here in canada as she had no choice but to go back to take care of her mom, , her mom recently passed , so now she is in canada for last 6 months and her pr card is expiring soon, also I am a Canadian citizen and I stay with her for a year as outside canada as she was infected with covid badly, so I had to go back and take care of my wife and her mom , now can she apply for PR renewal on H& C ground as she was the only daughter and there was no one else to take care of her sick mom, also will my one year spend with her outside canada as I am canadian citizen, we lived together could be counted towards residency..thankyou

She should wait until she meets the 730 days in the past 5 years before she renews her PR card. Your time together abroad may not count because you travelled to accompany her and the travel wasn’t accompany the Canadian citizen. If she is already in Canada there is no reason to risk trying to renew her PR card early.

Ok thanks, will finish the residency obligations and apply, but can she still apply under H&c grounds because she was the only daughter and her mom was sick and had prolonged illness...thank u

I agree that your wife should wait to renew your PR card until she meets the residency obligation. This is the best path.

She will not be able to count the time you spent with her outside of Canada towards PR. IRCC applies the who accompanied whom rule for these situations. Your wife was outside of Canada for her own reasons (not because of your job) and so you should expect that IRCC won't allow your wife to count this time towards PR. Only time spent physcially in Canada will count.

She can, but there's always risk in doing that. The safest path is to wait until she meets RO before applying.

It is a risk. She was able to remain in Canada for periods 3-4 months so she was able to find care during that period. Why would you risk applying if she is already in Canada? If she was stuck outside Canada it would be worth the risk.
