Hey,

I posted some stuff earlier this year regarding my situation and my renewal of PR card. Basically what it comes down to is that I have 7months more to fulfill my 2yr residency obligation. My question is, when would it be a good time to send in the renewal request for my PR card, as well as my mothers. August 20 2011 would be exactly 2yrs. We want to travel in September. We were trying to get home since earlier this year because I have a very sick grandmother who is holding on until she sees us again. Is it possible that I can apply for renewal under urgency a week before the 20 Aug? Do you think we would be able to get our renewed cards within 4wks?
 
Do NOT apply to renew until you have at least 730 days in Canada in the previous 5 year period before you apply. If you apply before then, you are ensuring that your application will be delayed because you do not meet the residency requirements.

Could you get it in 4 weeks, possibly. If you are very close to the residency requirements they might want to take a closer look at your application in which case they will not give it to you.

I hope you have good proof of your 730 days so you can prove it without a doubt. If none of your 730 days were exactly 5 years ago, that is you are not losing time of residency by leaving Canada for a month, you could also leave without your PR cards and apply for travel documents to get back.

If he leaves without the PR card, how easy is it to get a travel doc at the embassy? I know embassy folks can be very irrational. Would he need to "proof beyond doubt" that he has been in Canada to get a travel doc?
 
Same as what could happen if he applies to renew his PR card is that they don't believe his 730 days and do an investigation and it takes a year or more to get an interview and prove to them that he really has 730 days. With a travel document, he might also be denied and have to appeal and could take a long time.

If he has 730 days in Canada in the last 5 years and can prove it, I don't think he has too much to worry about but if a part of his 730 days was gained 5 years ago, say he stayed in Canada for a year, then left for 3 and then came back for a year, he can not do this because if he leaves Canada now, his 730 days will start disappearing since each day, he is outside Canada, losing a day from inside Canada 5 years ago. It is not enough to meet the residency requirements after some 5 year period. It has to be met in each rolling 5 year period. If he needs to apply for a travel document, he needs to meet the residency requirements on the day he applies.
 
Hey, thanks so much for the reply. Means a lot. I understand I have to have the 730 days. On Aug 20 2011 it will be exactly 730 days and I have all the proof they would need to prove that. 20th Aug falls on a saturday, would it be ok to send in the application on the 19th which is a friday?

Also, would it be any faster for consideration if I also went through the MP's office? Because like i said, we have been trying to travel home since Aug this year, so when we have the days accumulated, we really would like to get urgent processing for at least in Sept. Do you think it would be possible or would you recommend any advice for urgent processing during that time?

Write them of your plans to travel and ask them to expedite. I don't know if your MP can pull some strings to get it faster. Sometimes they are good to push things that are stuck but I don't know if having your MP involved from the start will help. I think it's ok to mail it on a Friday, just date your application on the 20th.
