Hi,

If I am currently in Canada on expired PR card status, can my parents (from visa exempt country) who are now physically visiting me in Canada request to extend their visitor visa from CIC? I'm aware that in order not to trigger any downstream effect, I should not sponsor them for supervisa as my status will be thoroughly check, but will this also applies if my parents are extending their visitor visa and in the process stating my name in their application form?

Alternatively, if they travel out to US for a week and return to Canada thereafter, will the border officer "reset" the 6 months stay allow for visitor? Or should they travel to elsewhere further such as Carribean?

Your advice is greatly appreciated!

Thanks

A bit confused on your comments.

1. are you not fulfilling your PR obligations OR
2. you have fulfilled your obligations, however your current PR card is in a expired status ?

if latter, there is no issues. as a PR you do not need to have a PR card to maintain your residency - unless you travel out - then in which case you need a PR card to re-enter.

I don't think there will be any risk to you for your parents to mention your name while applying to extend their visa.

If they go to the US and get a new passport stamp upon coming back, they would normally get another 6 months. However, it is up to the immigration officer. If the immigration officer feels that they are actually living in Canada without proper status or they have spent too much time, they can decide to stop them from entering or allow them to enter with less time. The rule of thumb for a visitor is not to spend more time visiting than they spend at home so a rough guide is 6 months in / 6 months out.

Hi cecapplied,

Sorry for not being clear in my comments earlier, it's more of what you indicated in point 1. That is I've not fulfilled my PR obligation yet, I am now in Canada and not sure whether my parents can state my name in the visitor extension application, wonder whether will that trigger any check by CIC why I have not renewed my PR card. Any thought on this?
