PR not Met due to my small child(Pls Help)

Dear ALL
I & my daughter got PR in October 2006 (my daughter was one & half year old in 2006) & our PR card is valid till 2011 October. In the period weonly stayed 3 months in Canada. It is because I am a single parent & It is difficult for me to carry out my daughter ( now 6 years old) in canada & taking care of her as well as doing a job. In india I am looking after her with the help of my old mother. I was divorced before getting PR for Cabada & custody of my daughter is with me. So me & my daughter entered canada first time in 2006.
Now I know that I could not met residency obligation of 730 days in last five years. MY question is as under
1. Can Candian immigration authorities allow us(me & my daughter) to retain our PR on humantarian ground?
2. Can We enter Canada now as our PR card is still valid till Oct 2011?
3. Where to Put our request for PR retention?

PLs help me so that myself & small daughter could leave a good life.....

Many people are single mothers in Canada. Not having child care for your daughter (having spent only 90 days in Canada) are not sufficient grounds for H&C consideration unfortunately.

Other people might be able to shed some light into this.
According to immigration you have not satisfied requirements of a PR and therefore you are no longer a Permanant Resident. Best option will be to apply again as a PR.
The fact that it was difficult for you to carry out your daughter and doing a job being a single mother does not count as a valid reason. In Canada there are single mothers doing 2 to 3 jobs and managing more than one child and running the household.
Again I am hoping someone can shed some more light into this matter but if you are still in India then your chances of retaining your PR is pretty slim

I am single father not mother, had I been a mother I could have take care of my daughter comparatively in easy way. Can this make a difference. Pls reply

No, it will not make a difference. If a single mother in Canada can work outside the home and put her child in daycare, so can a single father. How do you think it would have been easier for a mother?

One thing you can try with no guarantee of success is taking your daughter to Canada while your PR card is still valid and see if you get in. If you get in without any questions being raised, you can stay for 2 years without leaving or trying to renew your PR card. At that point, you meet the residency requirements again and can apply to renew your PR card.

If they realize as you enter Canada that you do not meet the residency requirements, they can start proceeding to revoke your PR and you can appeal this but with no guarantee of success.
