PR- LMIA exempt for open Work Permit ???

Hi All,

Currently I am on Open Work Permit and is working for employer from past 1 year, I am trying to convince my employer to provide me with offer letter so that it can add 50 points on my PR application but need confirmation if I am eligible for LMIA exempt. Since my employer is not willing to apply for new LMIA.

Please find few details of my work permit :

Case Type : 54
LMIA or Exempt No. - (Blank)
Employer - (Blank)

So, will I be exempted for LMIA or my employer needs to apply for new LMIA ?

Unless the profession is exempt from LMIA, you must have an LMIA to claim the points. If you only don't need an LMIA because you're on an OWP, that doesn't work.

Unfortunately you cannot claim the 50 points on an open work permit and without an LMIA. Your employer needs to obtain an approved LMIA to get the 50 points.

The only way you can get the 50 points without an approved LMIA is if you are on a closed work permit specifically naming your employer and have worked for that employer for a year in Canada (and have the letter you mention).

Are we able to claim this Canada work experience points for PNP? I am on PGWP for 1+ years.

I have got done my bio-metrics and medical in January 2021.
Can anyone guide what is the next step in the process?
If I get work permit under LMIA exempt category and I work for more than a year in ON, will I be considered as an experienced class category for PR?

I'm assuming this is paid work and you are applying for a closed work permit.

Once the work permit has been approved and you have worked in Canada for a full year on the closed work permit, you can claim 50 points for having a job offer in Canada. Your employer will also need to provide you with a letter stating that they will continue to employ you for a year after you become a PR. This is also required to claim the 50 points.
