Hey Everyone,
Please answer this question
It’s regarding my sister who came in Canada in 2017 on study permit then in 2020, immigration refused to extend her study permit since then she is living in Canada with no legal status. Last week she get married to Canadian citizen now we are being told she has to be on some sort of status in order to apply the pr with in Canada otherwise she has to go back to india and apply from there.
Please let me know if this is true if yes, is there any way she can apply the pr without going back to india?

She can submit an Inland Spousal Sponsorship application (SCPLC). The requirement to have legal status is waived under a Public Policy for this type of application. It does not absolutely guarantee that she will not be removed from Canada, but most people without status (as long as they are not otherwise inadmissible) have no problems.

She will not be eligible for an Open Work Permit, because of her lack of status, until the application reaches the Approved in Principle (AIP) stage, which could take several months. She should obviously remain in Canada, as re-entering and encountering CBSA could be a problem for her.

  • a reference or experience letter from the employer, which
    • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
    • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits; and
